CSJ # 0914 -33 -069 Fed.# STP 014(131)TE <br />District # AUS - I4 <br />Code Chart 64 # 02100 <br />Project: Cross -Town Pathway <br />Federal Highway Administration <br />CFDA # 20.205 <br />Not Research and Development <br />STATE OF TEXAS § <br />COUNTY OF TRAVIS § <br />LOCAL TRANSPORTATION PROJECT <br />ADVANCE FUNDING AGREEMENT <br />For a Transportation Enhancement (TE) Project <br />This Local Project Advance Funding Agreement (LPAFA) is made by and between the State <br />of Texas, acting by and through the Texas Department of Transportation, called the "State ", and <br />the City of San Marcos, acting by and through its duly authorized officials called the "Local <br />Government'. <br />WITNESSETH <br />WHEREAS, a Master Agreement between the Local Government and the State has been <br />adopted and states the general terms and conditions for transportation projects developed <br />through this LPAFA; and, <br />WHEREAS, the Local Government prepared and submitted to the State a nomination form for <br />consideration under the Transportation Enhancement Program for the project which is briefly <br />described as Cross -Town Pathway, called the Project; and <br />WHEREAS, the Texas Transportation Commission (the Commission) passed Minute Order <br />Number 113642 dated July 25th, 2013 awarding funding for projects in the 2012 Program Call of <br />the Transportation Enhancement Program, including the Project; and <br />WHEREAS, the rules and procedures for the selection and administration of the Transportation <br />Enhancement Program are established in 43 TAC Sections 11.200 et seq.; and <br />WHEREAS, the governing body of the Local Government has approved entering into this LPAFA <br />by resolution or ordinance dated t?, which is attached to and made a part of <br />this LPAFA as Attachment A; <br />NOW, THEREFORE, in consideration of the premises and of the mutual covenants and <br />agreements of the parties hereto, to be by them respectively kept and performed as hereinafter <br />set forth, it is agreed as follows: <br />AGREEMENT <br />1. Period of the Agreement <br />The period of this LPAFA is as stated in the Master Agreement, without exception. <br />2. Tennination of this LPAFA <br />The termination of this LPAFA shall extinguish all rights, duties, obligations, and liabilities of <br />the State under this LPAFA. This LPAFA shall be terminated under the conditions as stated <br />in the Master Agreement or for the conditions, and in the manner, described in this LPAFA. <br />AFA —LPAFA TE Page 1 of 13 Rev. 01 /17/2014 <br />
