District; and including procedural provisions; and consider adoption of Zoning Ordinance <br />2009-17. 0 <br />At approximately 8:09 p.m. Mayor Narvaiz opened the Public Hearing. There being no <br />comment, the Public Hearing was closed at 8:09 p.m. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to approve Zoning Ordinance <br />2009-17, as previously captioned. The motion carried unanimously. <br />35. Consider adoption of Ordinance 2009-18, on emergency, amending the city's 2008-2009 <br />budget to authorize the expenditure of state forfeiture funds in the sum of $18.000 for the <br />engineering and design of improvements to the server room at the San Marcos Police <br />Department; declaring an emergencv and providing an effective date. <br />MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember <br />Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance <br />2009-18, as previously captioned. The motion carried unanimously. <br />36. Consider adoption of Ordinance 2009-19, on emeraenev, amending sections of the <br />Animal Control Ordinance by deleting the requirement for microchipping of household <br />pets, deleting the prohibition against the sale or adoption of animals in parking lots and <br />allowing the keeping of hens in residential areas, declaring an emergenev, and providing an <br />effective date. • <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Couch, the City Council voted seven (7) for and none (0) opposed, to approve <br />Ordinance 2009-19, as previously captioned. The motion carried unanimously. <br />37. Consider adoption of Ordinance 2009-20, on emergeney, amending Chapter 2, <br />Administration, Article 3, Section 2.369 to revise the composition of the Economic <br />Development Board; including procedural provisions; and declaring an emeruncv and <br />providing an effective date. <br />MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Jones, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance 2009- <br />20, as previously captioned. The motion carried unanimously. <br />38. Reconsideration of Zoning Ordinance 2009-12, amending the future land use map from <br />"GC" General Commercial, "CC" Communitv Commercial, and "OS" Open Space, to <br />"HDR" High Densitv Residential for a 22.504 acre, more or less piece of land; and <br />amending the official zoning map of the City changing the base zoning from "GC" General <br />Commercial district to "MIT-18" Multi-Familv district for a 12.743 and 9.761 acre, more or <br />less, tract of land out of the JM Veramendi Survey No. 1, Abstract No. 17; and approving a <br />land use plan and development standards for the Purgatory Creek PDD; including <br />procedural provisions; and providing for penalties. • <br />RM033109 Minutes Page 8
