The maximum impervious coverage permitted on the Project Site shall be 60% (including buildings, parking structures, driveways, etc.). 4.11. Parks and Open Space. The Project Site will require the dedication of approximately 3.08 acres of parkland, the payment off a fee-in-lieu of parkland dedication or a combination thereof to meet the requirements of Chapter 7, Article 6 of the City of San Marcos Land Development Code. Any parkland dedication or fee-in-lieu of requirement will be subject to review by the City of San Marcos Parks and Recreation Commission and approval by the Planning and Zoning Commission. Parkland dedication may include the dedication of the native floodplain and floodway of Purgatory Creek that is unaltered by channelization or other man-made storm water control facilities. In the parkland dedication, a hike and bike trail will be constructed in conformance with the City's Parks and Recreation master plan. Final location and design of the said trail will be subject to joint approval by the Director of the Parks and Recreation Department and the developer. In accordance with the Future Land Use Plan, the potion of the site that lies within the floodplain or floodway shall remain as open space through the dedication of parkland and/or recreation easement. In the event that fee in lieu of parkland dedication is required, dedication of said recreation easement and/or parkland, shall not be required. In addition, the Project Site will include private amenity facilities for use by residents within the development including, but not limited to, a resort-style swimming pool, fully- equipped fitness center, clubhouse, picnic area, and approximately a 1.2 acre lake. 4.12. Fences. Fences shall be permitted in accordance with Chapter 6, Article 1, Division 3 of the City of San Marcos Land Development Code, except that fences may be permitted within the building setback line.
