Texas Department of Transportation
AUSTIN DISTRICT P.O. DRAWER 15426 AUSTIN, TEXAS 78761 -5426
February 19, 2009
Mr. Oscar Harrell
Director of Public Works
City of San Marcos
630 E. Hopkins
San Marcos, Texas 78666
Dear Mr. Harrell:
Enclosed are two unsigned original documents of a Multiple Use Agreement (MUA) between the
Texas Department of Transportation (TxDOT) and the City of San Marcos. This agreement is to
allow the City to install and maintain sidewalks and their associated drainage structures on the
west side of Loop 82 (Guadalupe St.) from the intersection with Grove St. to a distance of
approximately 1,200 feet north.
In order to submit this agreement for approval to the Maintenance Division of TxDOT we will
need a resolution or ordinance number entered on the front page along with the date of
resolution /ordinance approval. We will also need an authorized signature representing the City
of San Marcos on page 7 of the document. In the MUA documents I have highlighted in yellow
the lines where information will need to be entered by the City. Filling this information in by
hand is quite acceptable.
The City's resolution will need to clearly indicate its commitment to abide by the terms of the
Multiple Use Agreement and to maintain the sidewalk and associated drainage structures at no
cost to the State of Texas. Upon returning the signed documents I will also need a copy of your
approved resolution so I can attach it to the MUA as an exhibit.
You will note in these documents that Exhibits B, C, D, and E are currently empty. The project
plans and other information specified for these exhibits are not necessary at this time. I will
attach the proposed project plans (Exhibit B) when I send the MUA to the Maintenance Division
for their review. Exhibit C (the final approved construction plans) will be made part of the
document after Maintenance Division's approval of the MUA and before construction actually
begins. Likewise, Exhibit D (Certification of Insurance) will be added to the document prior to
actual construction.
Place this information and the signatures on both original documents and then return both
documents to the Austin District. Return the documents to the following address:
Texas Department of Transportation
Austin District, Maintenance Operations
P. O.
