DRAWER 15426 • AUSTIN, TEXAS 78761 -5426 • (512) 832 -7000 May 19, 2009 Mr. Rick Menchaca, City Manager City of San Marcos 630 East Hopkins San Marcos, Texas 78666 Dear Mr. Menchaca: Enclosed is the City's copy of the executed Multiple Use Agreement between TxDOT and the City of San Marcos to allow for the construction of the public sidewalk and associated drainage structures within the Loop 82 (Guadalupe Street) right -of -way. The limits of this project run from the intersection of Guadalupe Street with Grove Street to a distance of approximately 1,200 feet north. Now that this agreement is fully executed the City is free to proceed with plans to construct the sidewalk within the State's right -of -way. As stipulated in the agreement, the only thing needed prior to the City's contractor entering the right -of -way is for the contractor to submit a certification of insurance on Form 1560 (copy attached). The contractor must use this form; no other evidence of insurance will be accepted. Upon completion of the form, the contractor or his insurer can mail the document or fax it to me at the number provided on the form or they may send a scanned copy of the document to wrehnboadot.state.tx.us. The only other item needed is a copy of the final construction plans. I am currently working with Klotz Associates to receive these plans once final revisions have been made. Also, please be advised that any elements of the sidewalk within the Loop 82 right -of -way found not to comply with the requirements of the ADA or the Texas Accessibility Standards shall be corrected entirely at the expense of the City.
