38 RESOLU'rION 1993- 144R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING AMENDMENT NUMBER ONE TO THE AGREEMENT WITH BROWNING- FERRIS, INC. TO INCREASE THE BASE RESIDENTIAL SOLID WASTE COLLECTION RATE, AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT, AND ! DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos entered into an agreement (the "Agreement") with Browning-Ferris, Inc. on August 31, 1992, for . solid waste collection and disposal and related services; and, WHEREAS, the Agreement provides for price adjustments based on changes in the consumer price index; and, WHEREAS, the Agreement provides for price adjustments caused by revised laws, ordinances, and regulations that increase landfill disposal charges; and, WHEREAS, an increase in the Base Residential Rate of $.13 is justified on the basis of changes in the consumer price index; and, .. WHEREAS, an increase of $.20 in the Base Residential Rate of the Agreement is justified on the basis of costs associated with revised regulations¡ now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That an amendment to the Agreement between the City of San Marcos and Browning-Ferris, Inc. to increase the monthly Base Residential Rate by $.33 to $6.43 per month is hereby approved. PART 2. That the city Manager, Larry Gilley, is hereby authorized to execute Amendment Number One to the Agreement on behalf of the city of San Marcos, in the form attached to this Resolution. PART 3.
