<br />-" ~ 39 <br /> AMENDMENT NUMBER ONE <br /> TO THE AGREEMENT FOR SOLID WASTE COLLECTION <br /> AND DISPOSAL BETWEEN THE <br /> CITY OF SAN MARCOS, TEXAS AND BROWNING-FERRI S, INC. <br /> WHEREAS, on August 31, 1992, the City of San Marcos, Texas, <br />entered into a contract (the "Agreement") with Browning-Ferris, <br />Inc. for solid waste collection and disposal and related services <br />for the City; and, <br /> WHEREAS, Browning-Ferris, Inc. has requested an amendment to <br />the Agreement to increase the monthly base residential rate by <br />$0.33 on the basis of changes in the consumer price index and costs <br />associated with revised landfill regulations; ~ <br /> Now, therefore, it is understood and agreed by the parties <br />hereto that the following amendment is incorporated into the <br />Agreement: <br /> 1. Effective September 1, 1993, the Contractor's rate per <br /> residential unit per month for curbside solid waste <br /> collection two days per week is increased from $6.10 to <br /> $6.43. , <br /> 2. The third sentence of Section 13.02(a) of the Agreement <br /> is amended to read as follows: <br /> All percentage changes are to be computed as the <br /> difference between the index value for July of the <br /> preceding year and the index value for July of the <br /> current year divided by the index value for July of the <br /> preceding year. <br /> 3. All other terms and conditions of the Agreement shall <br /> remain in full force and effect. <br /> In witness whereof, we, the contracting parties, by our duly <br />authorized agents, hereto affix our signatures and seals. <br />
