1) City Manager: Deliberation on the evaluation process of the City Manager. • <br />2) City Clerk: Follow up on the December 16, 2008 evaluation and presentation of a <br />business plan. <br />The Executive Session adjourned at 11:40 p.m. on Tuesday, April 7, 2009. <br />4. Reconvene and Consider Action on Item Discussed During Executive Session. <br />The San Marcos City Council reconvened into regular session at 11:40 p.m. on Tuesday, April 7, <br />2009. Council directed staff on how to proceed with the real property, established the evaluation <br />process for the City Manager, and accepted the business plan from the City Clerk. <br />5. Invocation <br />Pastor Santiago Heredia, of El Buen Pastor United Methodist Church, provided the invocation. <br />6. Pledge of Allegiance <br />Councilmember Couch led the assembly in the Pledge of Allegiance. <br />7. Citizen Comments <br />Gary Hampton, 7100 Old Bee Cave Road, Austin, Texas, CEO of Keystone Construction Inc., • <br />stated that he employs San Marcos and Hays county citizens. Last year his company did $25 <br />million in the construction of water and wastewater treatment plants. He stated that his company <br />was the lowest bidder on the San Marcos wastewater treatment plant expansion. He has received <br />a letter from staff stating they were recommending awarding the bid to the second lowest bidder. <br />He was told he could come before Council and request they reverse the recommendation. He <br />provided a packet of evidence to the Council. He stated that if his company is not awarded the <br />bid, he may have to lay off San Marcos employees. This project was given to a non-local, <br />second lowest bidder. He asked, if after Council reviews his packet, could this be placed on the <br />April 21 consent agenda and award this bid to the local, lowest bid. <br />Jim Pentecost, 210 Deertrail, a licenses irrigator, addressed the irrigation plan for homeowners. <br />He noted the State has certain rules and regulations. There is an exemption stating a homeowner <br />may install his own irrigation, but he must follow state rules. Chapter 30 states a homeowner is <br />exempt, but he must abide by Chapter 344. Chapter 344 clearly describes what the homeowner <br />must do. They must abide by regulations, such as spacing, pressure, rain and water sensors, etc. <br />He also noted that the City has more stringent requirements than the state, and as an irrigator, he <br />is for that. <br />Bill Knight, 2208 Chaparral, Manchaca, Texas, stated he wishes to keep the San Marcos codes as <br />they are. The City has gone a step further in conserving water. As for homeowners, he wants <br />homeowners to be held to same standards as licensed irrigators. <br />0
