Consider an ordinance amending Chapter 14, Buildings and Building Regulations, <br />Article 6, Plumbing Code of the San Marcos City Code to change standards and <br />requirements for irrigation svstems to meet current state law; providing for penalties; and, <br />including procedural provisions; and consider ordinance of the first of two readings. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to approve the ordinance on <br />the first of two readings with changes made during discussion. The motion carried unanimously. <br />21. Consider adoption on second and final reading of Ordinance 2009-21, amending the <br />San Marcos City Code Section 34.701 to define the terms Excessive Noise and Unruly <br />Gathering; Amending Section 34.702 to prohibit party hosts or guests from causing <br />excessive noise, obstructing streets or driveways, engaging in or allowing alcoholic <br />beverage law violations or participating in or allowing an unruly gathering; prohibiting <br />owners and managers of apartment complexes from allowing common areas to be used as <br />venues for unrulv gatherings; providing for notification of property owners and managers <br />after two (2) verified excessive noise complaints, host or guest responsibility violations, or <br />unruly gatherings have occurred within a sixtv (60) day period; providing for agreements <br />• concerning future abatement strategies; authorizing a fee of $100 for each Police response <br />for repeated violations; repealing Sections 34.090 through 34.096 of the San Marcos Citv <br />Code; providing for penalties; including procedural provisions and declaring an effective <br />date. <br />MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember <br />Terry, the City Council voted six (6) for and one (1) opposed, with Councilmember Jones voting <br />against, to approve Ordinance 2009-21, as previously captioned, with an amendment by the City <br />Attorney, and setting an effective date to be thirty days from the date of publication. The motion <br />carried unanimously. <br />22. Reconsideration of Ordinance 2009-15, adopted March 31, 2009, amending the future <br />land use map from Low Density Residential (LDR) to Mixed Use (MU) for a 0.285 acres, <br />more or less, tract of land located at 1420 W. Hopkins Street; amending the official zoning <br />map of the City by rezoning this tract from Single-Family Residential District (SF-6) to <br />Mixed Use District (MU); and including procedural provisions. <br />There was no reconsideration of Ordinance 2009-15. <br />23.
