<br />79 <br /> <br /> <br /> <br />Regular Meeting July 12, 1993 Page 3 <br /> <br /> <br />MOORE: Plummer, Hart, Morris, Cox <br />WINDHAM: Mooney <br />BISHOP: Guerra <br /> <br /> <br />I Mayor Morris introduced for conside.ration the City Manager's <br />appointment of Police Chief. Mr. Gilley introduced Mr. Larry <br />I Kendrick who is currently Assistant Chief of Police to the city of <br />I Houston. Mr. Cox moved that the council approve the appointment of <br />police Chief. Mr. Guerra seconded the motion which passed <br />unanimously. Mr. Gilley stated that Mr. Kendrick would start work <br />with the city on August 2nd. <br /> <br />Mayor Morris introduced a public hearing and adoption of a <br />zoning Ordinance, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE FUTURE LAND USE MAP OF THE <br />MASTER PLAN OF THE CITY, FROM LOW DENSITY RESIDENTIAL TO <br />PUBLIC FOR LOT 38 OF BLOCK A, PARKLANE GARDENS HOMES <br />SUBDIVISION, PHASE II AS RECORDED IN VOLUME 5, PAGE 165 <br />OF THE HAYS COUNTY PLAT RECORDS AND LOT 59 OF BLOCK A AND <br />LOT 33 OF BLOCK B OF THE SUNRIDGE P.U.D. SUBDIVISION AS <br />RECORDED IN VOLUME 4, PAGES 309-311 OF THE HAYS COUNTY <br />PLAT RECORDS, AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Hart abstained from voting on Item 6A, 6B, 6C and 6D. Mr. <br />Guerra stated that he did not have a financial interest in victoria <br />Bank but however he did live in that area. Mayor Morris asked the <br />Assistant city Attorney if a mortgage counted as having a conflict <br />of interest. Ms. Davis stated that it did. Mayor Morris also <br />abstained from Item 6A, 6B, 6C and 6D. Mayor Morris then asked <br />Mayor Pro Tem Mr. Plummer to conduct the public hearing. Mayor Pro <br />Tem opened the public hearing and asked if anyone wished to speak. <br />No one did, so Mayor Pro Tem Plummer closed the public hearing. <br />Mr. Guerra asked Mr. Patterson what the relationship was between <br />Item 6A and others to follow. Mr. Patterson stated that all these <br />items are basically taking a planned unit development which was <br />done in the mid 1980's and a new developer has come along and wants <br />to convert it back to normal single member family lots from the <br />patio home lots. Mr. Patterson stated that the developer would <br />take every two patio home lots and combined them into a single <br />residential lot that would be larger than the once presently at <br />Castle Forest. Mr. Guerra stated that he had gotten notified <br />because he is a property owner and lives within a certain distance <br />and he would have to abstain from Item 6A,B C and D. Mr. Guerra <br />stated that the Council could not conduct business because he could <br />not vote. Mr. Cox moved that this Item be tabled until the meeting <br />of July 26th. Mr. Plummer seconded the motion. Mr. Guerra asked <br />if he could vote on the motion to table. Ms. Davis stated that she <br />was not sure. Mr. Gilley stated that it could simply be that there <br />can be no action taken. Mayor Pro Tem stated that then the Council <br />would have to redo the public hearings. Mr. Gilley stated that the <br />Council would have to go on to the next item because there is no <br />action that can be taken. Ms. Davis stated that Items 6A, B, C, <br />and D needed to be tabled. Mr. Guerra moved to tabled Items 6A, B, <br />C and D until the July 26th meeting. Mr. Cox seconded the motion. <br />The following vote was recorded: <br /> <br />AYE: Guerra, Cox, Plummer, Mooney <br /> <br />NAY: None <br /> <br />ABSTAIN: Hart, Morris <br />
