1 1, -S <br />2?. <br />At_... ,.... ?O'cIor?k-„ M <br />ORDINANCE NO. 1981-73 <br />A U G 1 99 11 <br />' VV SECF'RETARY, <br />AN ORDINANCE OF THE CITY COUNCIL OF THE C? ?, <br />-s <br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF TY?f,?an Marco <br />ORDINANCE WHICH REGULATES AND RESTRICTS THE LO- <br />CATION AND USE OF BUILDINGS, STRUCTURES AND LAND, <br />DATED SEPTEMBER 29, 1980 (VOL. 54) BY ZONING TWO <br />TRACTS OF LAND OUT OF FARM LOT NO. 22 OF THE <br />ORIGINAL TOWN OF SAN MARCOS, LOCATED IN THE 400 <br />BLOCK OF NORTH GUADALUPE STREET, FROM "D" (MULTI- <br />FAMILY DWELLING DISTRICT) TO "C" (COMMERCIAL DIS- <br />TRICT). <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. That the following described real property located in the <br />City of San Marcos, Hays County, Texas, which is presently zoned "D" <br />(Multi-Family Dwelling District) henceforth shall be rezoned as fol- <br />lows: <br />FIRST TRACT: All of that certain tract of land and real property sit- <br />uated in the City of San Marcos in Hays County, Texas, out of Farm Lot <br />No. 22, of the Original Town of San Marcos, according to the map or <br />plat of said town recorded in Volume 46, Page 448, Hays County Deed <br />Records, and being also part of that parcel of land described in and <br />conveyed by that deed dated February 20, 1894, from Mrs. Mary J. <br />Franklin to Thomas C. Johnson, recorded in Volume 32, Page 117, Hays <br />County Deed Records, said tract hereby conveyed fronting 21 feet on <br />the West side of Guadalupe Street and extending back between parallel <br />lines at right angles to the line of said street approximately 333-1/3 <br />feet to the East line of Fredericksburg Street and which 21 foot strip <br />of land is described particularly by metes and bounds as follows: <br />BEGINNING for the Southeast corner of this tract in the East line of <br />said Farm Lot No. 22 in the West line of Guadalupe Street at a point <br />North 8-1/2° West 105 feet from the Southeast corner of the land so <br />conveyed by Mary J. Franklin to Thomas C. Johnson by deed above re- <br />ferred to, such Franklin to Johnson corner being also the Northeast <br />corner of tract conveyed by J. T. Smith, et al, to James W. Smith, by <br />deed dated April 4, 1941, recorded in Volume 123, Pages 242-244, Hays <br />County Deed Records; and which place of beginning is also the North- <br />east corner of that 105 foot strip of land hereinafter referred to; <br />THENCE North 8-1/2° West and with the West line of said Guadalupe <br />Street, 21 feet to a point for corner for the Northeast corner of <br />this tract; THENCE South 81-1/2° West at right angles to said first <br />line, 333-1/3 feet, more or less, to a point for corner in the East <br />line of Fredericksburg Street for the Northwest corner of this tract <br />in the West line of said Farm Lot and which point is North 8-1/21 West <br />126 feet from the Southwest corner of the property so conveyed by Mary <br />J. Franklin to Thomas C. Johnson; THENCE South 8-1/20 East and with <br />the East line of Fredericksburg Street, 21 feet to a point for corner <br />as the Southwest corner of this tract and the Northwest corner of a <br />strip of land 105 feet wide running from said Guadalupe Street line <br />to said Fredericksburg Street line adjacent to the South line of <br />said Mary J. Franklin to Thomas C. Johnson tract as set apart in <br />severalty to Louise J. Johnson in that partition between her and <br />others dated July 10, 1968, and recorded in Volume 225, Pages 93-97, <br />Hays County Deed Records; THENCE with the North line of said 105 <br />feet tract North 81-1/2° East 333-1/3 feet, more or less, to the <br />PLACE OF BEGINNING. <br />SECOND TRACT: All that certain tract of land and real property sit- <br />uated in the City of San Marcos, in Hays County, Texas, out of Farm <br />Lot No. 22, of the Original Town of San Marcos, in Hays County, Texas,
