33 <br />1 <br />THE STATE OF TEXAS <br />COUNTY OF HAYS <br />KNOW ALL MEN BY THESE PRESENTS: <br />ANIMkL OONTROL SERVICES <br />FOR GARY JOB CORPS CENTER <br />That the City of San Marcos, Texas, a municipal corporation lo- <br />cated in Hays County, Texas, existing by and under the laws of the <br />State of Texas, acting through authority conferred on its City <br />Manager A.C. Gonzalez, Jr. by resolution duly enacted on September 14, <br />1981 , hereinafter "City", and Texas Educational Foundation, Inc., <br />a Texas non-profit corporation, hereinafter "Foundation", enter into <br />this agreement for the provision to Foundation by City of services <br />of City's animal control department on the site of the Gary Job <br />Corps Center in Caldwell County, Texas. <br />I. <br />For and in consideration of Foundation's payment to City of <br />$200.00 per month, City shall perform the following services: <br />A. City shall patrol the Gary Job Corps Center staff <br />housing area once a month for the purpose of im- <br />pounding or confiscating cogs in said area which <br />are not under the supervision of the owner of the <br />dog. For purposes of this Agreement, a dog shall <br />not be considered to be under the control of the owner <br />unless the dog is on a leash, confined to a specific <br />area by a fend or other similar structure or being ex- <br />ercised with the owner in sight. It is intended by <br />the parties that said monthly patrols shall be of <br />approximately two hours duration. <br />B. City shall provide 24-hour, 7-day-a-week emergency <br />response service for animal-bite cases. <br />C. City shall receive those unwanted animals brought to <br />the San Marcos Animal Shelter by Gary Job Corps Center <br />personnel.
