<br />31 <br /> <br /> <br /> <br />Regular Meeting June 14, 1993 Page 3 <br /> <br /> <br />Mr. Plummer moved for approval of the Ordinance on first reading and <br />Mr. Moore seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 2-31 OF THE SAN MARCOS CODE OF <br />ORDINANCES TO INCREASE THE NUMBER OF POSITIONS WITHIN THE <br />CLASSIFICATION OF POLICE CAPTAIN FROM THREE TO FOUR; PROVIDING <br />FOR PUBLICATION AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for approval of the Ordinace on first reading and <br />Mr. Hart seconded the motion. The City Council requested Staff <br />ascertain if seizure money could be used to provide funding for this <br />position. The Council voted unanimously for approval of the <br />Ordinance on first reading. <br /> <br />Mayor Morris introduced for consideration adoption of a Zoning <br />Ordinance, the caption which was read as follows (public hearing was <br />held May 24, 1993): <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY bF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />LOT 1, BLOCK 5, OF THE SUNSET ACRES ADDITION TO THE CITY OF SAN <br />MARCOS, UNIT NO.1 AS RECORDED IN VOLUME 158, PAGE 393 OF THE <br />HAYS COUNTY DEED RECORDS, LOCATED AT 520 PATRICIA DRIVE, FROM <br />"C" (COMMERCIAL DISTRICT) TO "R-1" (SINGLE-FAMILY DWELLING <br />DISTRICT [LOW DENSITY]); AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Zoning Ordinance and Mr. Mooney <br />seconded the motion. The Zoning Commission reconsidered this zoning <br />change. Julie Jaimes, representing her mother, Mrs. Martinez, <br />stated they had discussed with Mr. Rodriguez the possibility of an <br />exchange of lots, but did not choose to exchange lots with him. <br />Rick Hernandez, representing Mr. Rodriguez, stated the neighborhood <br />within 200 feet wants the property to remain zoned commercial. Mr. <br />Patterson stated the land use for the property is Low Density <br />Residential and the zoning change is needed for Mrs. Martinez to <br />build a home. He stated variances are not granted on use of <br />property, but on such matters such as heights. The Council voted <br />unanimously for adoption of the Zoning Ordinance. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING APPENDIX A - GENERAL ZONING ORDINANCE OF THE <br />CODE OF ORDINANCES OF THE CITY WITH REGARD TO THE PROCEDURE FOR <br />APPLYING FOR A ZONING MAP AMENDMENT, AND CONSIDERATION OF <br />PREVIOUSLY DENIED ZONING MAP AMENDMENTS; AMENDING THE <br />DEFINITIONS OF BUILDING, LOT, PARKING AREA OR LOT, AND <br />RECREATIONAL VEHICLE OR TRAVEL TRAILER; AMENDING THE NAME OF <br />DUPLEX DISTRICT TO TWO-FAMILY DWELLING DISTRICTS; CLARIFYING <br />MOBILE HOMES AS SPECIFIC USES IN A "PD" (PRE-DEVELOPMENT <br />DISTRICT), "RR" (RURAL RESIDENTIAL DISTRICT) AND "AR" <br />(AGRICULTURAL-RANCH DISTRICT); AMENDING ACCESSORY BUILDINGS AS <br />, PERMITTED USES IN AN "RR" (RURAL RESIDENTIAL DISTRICT), "SR" <br />. (SUBURBAN RESIDENTIAL DISTRICT), "R-1" (SINGLE-FAMILY DWELLING <br />DISTRICT [LOW DENSITY]), AND "R-2" (SINGLE-FAMILY DWELLING <br />DISTRICT [MEDIUM DENSITY]); DELETING RECREATIONAL VEHICLES AS <br />PERMITTED USES, AND CLARIFYING THE USE OF SINGLE-FAMILY <br />DWELLINGS IN AN "MH" (MOBILE HOME DISTRICT); AMENDING PERMITTED <br />USES IN A "C" (COMMERCIAL DISTRICT) TO ALLOW COMMERCIAL <br />CAMPGROUNDS OR RECREATIONAL PARKS; AMENDING SUPPLEMENTAL <br />REQUIREMENTS WITH REGARD TO MINIMUM LOT SIZE; AMENDING THE <br />REQUIREMENTS FOR OFF-STREET PARKING AT EATING AND DRINKING <br />ESTABLISHMENTS; ADOPTING FEDERAL AND STATE ACCESSIBILITY DESIGN <br />AND CONSTRUCTION STANDARDS FOR ACCESSIBLE PARKING SPACES BY <br />REFERENCE; AMENDING LANDSCAPING REQUIREMENTS FOR OFF-STREET <br />PARKING; AMENDING A REFERENCE TO THE "PLANNING BOARD" TO <br />SUBSTITUTE THE TERM "ZONING COMMISSION"; PROVIDING <br />
