57 <br />Regular Meeting <br />October 12, 1981 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ANNEXING TO SAID CITY A CONTIGUOUS <br />TRACT OF LAND CONTAINING APPROXIMATELY 153 ACRES, <br />MORE OR LESS, OUT OF THE J. M. VERAMENDI LEAGUE NO. <br />1 AND THE J. M. VERAMENDI LEAGUE NO. 2, SAID TRACT <br />LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION OF <br />SAID CITY AND LYING ADJACENT TO PRESENT CITY BOUN- <br />DARIES; EXTENDING THE BOUNDARY LIMITS OF SAID CITY <br />SO AS TO INCLUDE SAID TRACT; GRANTING TO THE INHA- <br />BITANTS OF SAID TRACT ALL THE RIGHTS AND PRIVILEGES <br />OF OTHER CITIZENS OF SAID CITY; BINDING SAID INHA- <br />BITANTS BY ALL OF THE ACTS AND ORDINANCES, RULES <br />AND REGULATIONS OF SAID CITY AND DECLARING AN EF- <br />FECTIVE DATE. <br />Mrs. Norris moved for the adoption of the Ordinance on third and <br />final reading and Mr. Cavazos seconded the motion. Mr. Andrew Gary, <br />an attorney representing the Thornton family, the owners of Cape's <br />Camp, addressed the Council advising them of House Bill 1952, which <br />became effective August 31, 1981. In that House Bill, it reflects <br />that the City furnish the residents of the proposed annexed area a <br />service plan, and Mr. Gary stated the Thorntons had not been furnished <br />a plan, as required. On roll call the following vote was recorded: <br />AYE: Cavazos, James and Norris. <br />NAY: Brown, Craddock, Kreczmer and Mendez. <br />ABSTAIN: None. <br /> <br />Mrs. Mendez then stated she had made an error in voting. Mr. Cavazos <br />then moved that the vote be recalled. After some discussion Mrs. Men- <br />dez asked that the motion be tabled. City Manager A. C. Gonzalez ad- <br />vised the Council they had already voted on the matter, that it would <br />not be proper to table the motion. Mr. Cavazos again moved that the <br />vote be recalled so that the matter could be further considered, and <br />Mrs. Norris seconded the motion, which passed unanimously. Mrs. Norris <br />then moved that the Ordinance be tabled until such time as the City <br />Manager, the Mayor and City Attorney had time to discuss the new legal <br />situation arising out of House Bill 1952, and Mr. Brown seconded the <br />motion. On roll call the following vote was recorded: <br />AYE: Brown, James, Craddock, Kreczmer, Mendez and Norris. <br />NAY: Cavazos. <br />ABSTAIN: None. <br />Mayor Craddock introduced for consideration a Resolution approving <br />the creation of Capital Area Housing Finance Corporation, the caption <br />which was read as follows: <br />RESOLUTION APPROVING THE CREATION OF CAPITAL AREA <br />HOUSING FINANCE CORPORATION; APPROVING THE ARTICLES <br />OF INCORPORATION THEREOF AND APPOINTING THE INITIAL <br />DIRECTORS THEREOF; AND CONTAINING OTHER PROVISIONS <br />RELATING TO THE SUBJECT. <br />Mr. Kreczmer moved for the adoption of the Resolution and Mr. James <br />seconded the motion, which passed unanimously. <br />Mayor Craddock introduced for consideration approval <br />date for the second Regular Council Meeting in Octob <br />duled for Monday, October 26, 1981 at 7:30 p.m. All <br />will be attending the TML Convention in San Antonio. <br />moved that the meeting be held Thursday, October 29, <br />and Mr. Brown seconded, which passed unanimously. <br />of an alternative <br />er, which is sche- <br />Council members <br />Mayor Craddock <br />1981 at 7:30 p.m. <br />Page 4 <br />The meeting adjourned at 9:30 p.m. on motion of Mr. Cavazos and se- <br />conded by Mr. James.
