109 <br />ORDINANCE NO. 1981-87 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />r OF SAN MARCOS, TEXAS, DECLARING THE NECESSITY <br />OF ACQUIRING A PORTION OF BLOCK TWO (2) OF <br />THE HOME FARM BLOCKS SUBDIVISION IN THE CITY <br />OF SAN MARCOS, TEXAS, SAID PORTION LOCATED AT <br />THE INTERSECTION OF GUADALUPE STREET AND ROOSEVELT <br />STREET, FOR A PUBLIC PURPOSE; DESCRIBING THE <br />PROJECT FOR WHICH SAID PROPERTY IS TO BE ACQUIRED;' <br />DESCRIBING SAID PROPERTY; AUTHORIZING THE CITY <br />ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS <br />AND DECLARING AN EFFECTIVE DATE. <br />WHEREAS, there exists a need to realign the intersection <br />of Roosevelt Street and Guadalupe Street so that said intersection <br />will conform with the intersection of Guadalupe Street and Love <br />Street, said intersections being located within the corporate <br />limits of the City of San Marcos, Texas; and, <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />hereby finds that said realignment would be of benefit to the <br />public because the present alignment of said intersections creates <br />a traffic hazard and said realignment would aid traffic flow <br />into and out of the Victory Gardens neighborhood; and, <br />WHEREAS, there exists the need for said city to acquire <br />additional right-of-way to complete said realignment; and, <br />WHEREAS, the City of San Marcos, Texas, has, by authority <br />of Article 1, 517 of the Texas Constitution, Article 3264 et <br />seq., Texas Revised Civil Statutes, and Section 2.02 of the <br />Charter of the City of San Marcos, the right of eminent domain <br />for any municipal or public purpose; and, <br />WHEREAS, the City believes ownership of a portion of Block <br />Two (2) of Home Farm Blocks Subdivision, a subdivision located <br />in the City of San Marcos, Hays County, Texas, and filed of <br />record in Volume 129, Page 226, Hays County Deed Records, said <br />portion being that tract of land conveyed to Asencion Cisneros <br />De Rojo by E.M. Cape by deed dated August 10, 1943, and recorded <br />in Volume 127, Page 406, Hays County Deed Records, and being <br />that tract of land conveyed to Asencion Cisneros De Rojo by E.M. <br />Cape by deed dated January 20, 1944, and recorded in Volume 129, <br />Page 90, Hays County Deed records, and being more particularly <br />described by metes and bounds as follows, to-wit: <br />BEGINNING at an iron pipe set at the Northeast <br />corner of the said Rojo tract recorded in Volume <br />127, Page 406, same being the Northeast corner <br />of the said Block 2, for the Northeast corner of <br />the tract herein described, and being at the <br />intersection of the South line of Roosevelt Street <br />with the West line of Guadalupe Street-State High- <br />way Loop No. 82, and from which a concrete monument <br />found, bears, S 07° 37' E, 177.61 feet; <br />THENCE, leaving the said Roosevelt Street, with the <br />West line of the said Guadalupe Street-State High- <br />way Loop No. 82, the East line of the said Block 2, <br />S 070 37' E, at 0.55 feet passing an iron stake found, <br />at 25 feet passing the Southeast corner of the said <br />Rojo tract recorded in Volume 127, Page 406, same <br />being the Northeast corner of the said Rojo tract re- <br />corded in Volume 129, Page 90, and continuing on, in <br />all, 40.00 feet to an iron pipe set at the Southeast <br />corner of the said Rojo tract recorded in Volume 129, <br />Page 90, for the Southeast corner of the tract herein <br />described, same being the Northeast corner of that tract <br />of land conveyed to Ralph Gonzales by Dionicia G. <br />Velasquez, et al, by deed dated December 12, 1968, and <br />recorded in Volume 227, Page 400, Hays County Deed <br />Records; <br />THENCE, leaving the said Guadalupe Street-State Highway <br />Loop No. 82, with the North line of the said Gonzales
