<br />the Southwest corner of the said Rojo tract re-
<br />corded in Volume 129, Page 90, for the Southwest
<br />corner of the tract herein described, same being
<br />on the west line of the said Block 2, and being
<br />on the East line of MacArthur Street;
<br />THENCE, leaving the said Gonzales tract, with the
<br />East line of the said Mac Arthur Street, the [nest
<br />line of the said Block 2, N 071 51' W, at 15 feet
<br />passing the Northwest corner of the said Rojo tract
<br />recorded in Volume 129, Page 90, the Southwest corner
<br />of the aforementioned Rojo tract recorded in Volume
<br />127, Page 406, and continuing on, in all, 40.00 feet
<br />to an iron pipe set at the Northwest corner of the
<br />said Rojo tract recorded in Volume 127, Page 406,
<br />the Northwest corner of the said Block 2, for the
<br />Northwest corner of the tract herein described, same
<br />being at the intersection of the East line of the
<br />said Mac Arthur Street with the South line of the
<br />aforementioned Roosevelt Street;
<br />THENCE, leaving the said Mac Arthur Street with the
<br />South line of the said Roosevelt Street, the North
<br />line of the said Block 2, N 821 23' E, 167.03 feet
<br />to the POINT OF BEGINNING containing 0.15 acres of
<br />land
<br />rests with the heirs of A,sen.cion. Cisneros de Rojo because both
<br />deeds conveying the above described property to Asencibn
<br />Cisneros de Rojo recite that said property is being conveyed
<br />as her sole and separate property and that the consideration is
<br />being paid out of her sole and separate funds and estate, although
<br />there exists the possibility that the property could be determined
<br />to be the community property of Asencion Cisneros de Rojo and
<br />Daniel R. Rojo, thereby placing ownership in the heirs of both;
<br />and
<br />WHEREAS, said city through diligent effort has been unable
<br />to reach an agreement with said owners as to the value of the
<br />land or the damages; now, therefore,
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />SECTION 1. That a portion of Block Two (2) of the Home
<br />Farm Blocks Subdivision, a subdivision located in San Marcos,
<br />Hays County, Texas, the plat of which is filed of record in
<br />Volume 129, Page 226, Hays County Deed Records, said portion being
<br />that tract of land conveyed to Asencion Cisneros De Rojo by E.M.
<br />Cape by deed dated August 10, 1943, and recorded in Volume 127,
<br />Page 406, Hays County Deed Records, and being that tract of land
<br />conveyed to Asencion Cisneros De Rojo by E.M. Cape by deed dated
<br />January 20, 1944, and recorded in Volume 129, Page 90, Hays County
<br />Deed Records, and being more particularly described by metes and
<br />bounds as follows, to-wit:
<br />BEGINNING at an iron pipe set at the Northeast
<br />corner of the said Rojo tract recorded in Volume
<br />127, Page 406, same being the Northeast corner
<br />of the said Block 2, for the Northeast corner of
<br />the tract herein described, and being at the
<br />intersection of the South line of Roosevelt Street
<br />with the West line of Guadalupe Street-State High-
<br />way Loop No. 82, and from which a concrete monument
<br />found, bears, S 07° 37' E, 177.61 feet;
