THENCE, leaving the said Roosevelt Street, with
<br />the West line of the said Guadalupe Street-State
<br />Highway Loop No. 82, the East line of the said
<br />Block 2, S 07° 37' E, at 0.55 feet passing an
<br />iron stake found, at 25 feet passing the Southeast
<br />corner of the said Rojo tract recorded in Volume
<br />127, Page 406, same being the Northeast corner of
<br />the said Rojo tract recorded in Volume 129, Page
<br />90, and continuing on, in all, 40.00 feet to an
<br />iron pipe set at the Southeast corner of the said
<br />Rojo tract recorded in Volume 129, Page 90, for the
<br />Southeast corner of the tract herein described,
<br />same being the Northeast corner of that tract of
<br />land conveyed to Ralph Gonzales by Dionicia G.
<br />Velasquez, et al, by deed dated December 12, 1968,
<br />and recorded in Volume 227, Page 400, Hays County
<br />Deed Records;
<br />THENCE, leaving the said Guadalupe Street-State
<br />Highway Loop No. 82, with the North line of the
<br />said Gonzales tract, S 821 23' W, 166.87 feet to
<br />a 60d nail set at the Northwest corner of the said
<br />Gonzales tract, the Southwest corner of the said Rojo
<br />tract recorded in Volume 129, Page 90, for the South-
<br />west corner of that tract herein described, same
<br />being on the West line of the said Block 2, and being
<br />on the East line of Mac Arthur Street;
<br />THENCE, leaving the said Gonzales tract, with the
<br />East line of the said Mac Arthur Street, the West
<br />line of the said Block 2, N 07° 51' W, at 15 feet
<br />passing the Northwest corner of the said Rojo tract
<br />recorded in Volume 129, Page 90, the Southwest corner
<br />of the aforementioned Rojo tract recorded in Volume
<br />127, Page 406, and continuing on, in all, 40.00 feet
<br />to an iron pipe set at the Northwest corner of the
<br />said Rojo tract recorded in Volume 127, Page 406,
<br />the Northwest corner of the said Block 2, for the
<br />Northwest corner of the tract herein described, same
<br />being at the intersection of the East line of the
<br />said Mac Arthur Street with the South line of the
<br />aforementioned Roosevelt Street;
<br />THENCE, leaving the said Mac Arthur Street with the
<br />South line of the said Roosevelt Street, the North
<br />line of the said Block 2, N 82° 23' E, 167.03 feet
<br />to the POINT OF BEGINNING containing 0.15 acres of
<br />land
<br />is needed for a public purpose by the City of San Marcos, Texas,
<br />SECTION 2. That said portion of land shall be used to re-
<br />align the intersection of Roosevelt Street and Guadalupe Street
<br />so that said intersection will conform with the intersection of
<br />Guadalupe Street and Love Street, said intersections being located
<br />within the corporate limits of the City of San Marcos, Texas.
<br />SECTION 3. That the City of San Marcos, Texas,believes
<br />ownership of said portion of Block Two (2) of the Home Farm
<br />Blocks Subdivision to the City of San Marcos to be in the heirs of
<br />Asencibn_:_ Cisneros de Rojo because of the recitations in the
<br />deeds of conveyance of said property, realizing, however, that
<br />ownership could be held to rest in the heirs of Asencion Cisneros
<br />de Rojo and Daniel R. Rojo should said property be found to have
<br />been community property.
<br />SECTION 4. That the city through diligent effort has been
<br />unable to agree with the owners of said portion of Block Two
<br />(2) of the Home Farm Blocks Subdivision to the City of San Marcos
<br />as to the value of the land or the damages.
<br />SECTION 5. That the city attorney for the City of San
<br />Marcos, Texas, Barbara Jean Edwards be, and she is hereby,
