1. On July 7 and July 21, 2015, the City Council of the City of San Marcos, Texas <br />conducted public hearings regarding the proposed annexation of multiple tracts of land and <br />associated rights -of -way within the city's extraterritorial jurisdiction. <br />2. Seventeen areas were originally proposed for annexation as identified in Exhibit <br />"A," attached hereto and made a part hereof for all purposes. Upon further consideration, <br />however, the City Council removed the areas identified as Areas 4, 8, 11, 13, 15 and 17 from <br />consideration for annexation under this ordinance. <br />3. The remaining areas, consisting of 946 acres, more or less of land, but excluding <br />any portions thereof subject to a development agreement under Section 43.035 of the Texas <br />Local Government Code, are the subject of this ordinance and further described in Exhibits "A- <br />1" through "A -I1," attached hereto and made a part hereof for all purposes (the "Annexation <br />Areas "). The properties originally within such Annexation Areas that are subject to development <br />agreements are identified in Exhibit "A -12," attached hereto and made a part hereof for all <br />purposes. <br />4. The Annexation Areas are contiguous and adjacent to the current boundaries of <br />the City. <br />5. The requirements of Chapter 43 of the Texas Local Government Code and other <br />applicable laws have been met. <br />BE IT ORDAINED BY THE CITE' COUNCIL OF THE CITE' OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The recitals of this ordinance are approved and adopted. <br />SECTION 2. The Annexation Areas described in Exhibits "A- I" through "A -11" and <br />listed below, excluding the portions thereof subject to development agreements described in <br />Exhibit "A -12," are annexed into and are a part of the City of San Marcos, Texas and subject to <br />the acts, ordinances, resolutions and regulations of the City (as noted in the Recitals, certain <br />areas originally proposed for annexation are intentionally omitted, thus leaving gaps in the <br />numbering sequence): <br />
