<br /> 9 <br />Regular Meeting May 24, 1993 Page 3 <br />Mr. Guerra moved for approval of the Ordinance on first reading <br />and Mr. Moore seconded the motion. Mayor Morris asked Mr. <br />Patterson what the setback was previously. Mr. Patterson stated <br />it was 20' and the staff suggested 15' so a compromise of 18' was <br />met. Mr. Patterson stated this would allow for a single parking <br />space on the side of a lot. Mr. Moore asked in Section 18, how <br />the number was met for parking requirements at eating and <br />drinking establishments. Mr. Patterson stated the Commission <br />followed national standards. Mr. Patterson also stated the <br />change in Section 18 was to add outside eating areas. Mr. Hart <br />complimented the Staff and the Zoning Commission for Section <br />37 (A) (11. 5) for a logical and practical approach. The Council <br />voted unanimously for approval of the Ordinance of first reading. <br />Mayor Morris introduced for consideration approval of an <br />Ordinance on first reading, the caption which was read as <br />follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 23.41 <br /> ACRES, MORE OR LESS, FRONTING ON THE NORTHWEST RIGHT-OF-WAY <br /> LINE OF INTERSTATE HIGHWAY 35 AT ITS INTERSEÇTION WITH <br /> CENTER POINT ROAD IN HAYS COUNTY, TEXAS, (LOWMAN PROPERTY) <br /> THIS LAND BEING LOCATED WITHIN THE EXTRATERRITORIAL <br /> JURISDICTION OF THE CITY AND LYING ADJACENT TO PRESENT CITY <br /> BOUNDARIES; APPROVING A SERVICE PLAN FOR THIS TRACT; <br /> EXTENDING THE BOUNDARY LIMITS OF THE CITY TO INCLUDE THIS <br /> TRACT; GRANTING TO THE RESIDENTS OF THIS TRACT ALL THE <br /> RIGHTS AND PRIVILEGES OF OTHER CITIZENS OF THE CITY; BINDING <br /> THE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES, RULES AND <br /> REGULATIONS OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Moore moved for approval of th~ Ordinance on first reading <br />and Mr. Plummer seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration reconsideration of Item <br />11A, a Zoning Ordinance. The Council did not wish to reconsider <br />this Ordinance. The caption was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br /> REZONING 0.371 ACRES, MORE OR LESS, OF LAND AREA BEING A <br /> PORTION OF BLOCK 10 OF THE D.S. COMBS ADDITION, CITY OF SAN <br /> MARCOS, HAYS COUNTY, TEXAS AS RECORDED IN VOLUME 42, PAGE <br /> 332 OF THE HAYS COUNTY DEED RECORDS, BEING ALL OF THAT TRACT <br /> OF LAND DESCRIBED IN A DEED FROM PINKIE LEE DOWELL TO THE <br /> CITY OF SAN MARCOS DATED DECEMBER 6, 1977 AND RECORDED IN <br /> VOLUME 303, PAGE 872 OF THE HAYS COUNTY DEED RECORDS <br /> TOGETHER WITH ALL OF THAT TRACT OF LAND DESCRIBED IN A DEED <br /> FROM JOSE MONTELONG ET UX TO THE CITY OF SAN MARCOS DATED <br /> MARCH 5, 1976 AND RECORDED IN VOLUME 282, PAGE 517 OF THE <br /> HAYS COUNTY DEED RECORDS, LOCATED AT 401 JACKMAN STREET, <br /> FROM "M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS <br /> DISTRICT TO lip" PUBLIC AND INSTITUTIONAL DISTRICT AND <br /> DECLARING AN EFFECTIVE DATE. <br />Mayor Morris introduced for consideration reconsideration of Item <br />lIB a Zoning Ordinance. Mayor Morris moved to reconsider Item <br />lIB and Mr. Moore seconded the motion. Mayor Morris stated she <br />met with Mr. Frank Contreras, who owns 608 Valley Street, who <br />stated the residents in this neighborhood were opposed to the use <br />of this property because of the use of dedicated parkland. Mayor <br />Morris asked Mr. Patterson if he was aware of the opposition. <br />Mr. Patterson stated there were several objections for use of <br />the property; residents wanted the lots <br />
