Mayor Morris introduced an Executive Session pursuant to Article 6252-17, Sections 2(e) and (f), V.A.C.S., to discuss pending , litigation (Sierra Club vs. Babbitt; City of San Marcos vs. Freeman Educational Foundation), matters where the City Attorney's ethical duty to the City clearly conflicts with Article 6252-17; and negotiated contracts for prospective gifts or donations to the City, respectively. Mr. Moore moved to adjourn into Executive Session at 9:35 p.m. and Mr. Hart seconded the motion, which passed unanimously. Mr. Moore moved to reconvene at 11:04 p.m. and Mr. Hart seconded the motion, which passed unanimously. Mayor Morris introduced for consideration adoption of a Resolution, the caption which was read as follows: . A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ACCEPTING A DONATION FROM THE SAN MARCOS CIVIC FOUNDATION FOR THE PURCHASE OF PROPERTY AT 222 W. SAN ANTONIO STREET; APPROVING A CONDITION IN THE DEED TO THE PROPERTY RELATED TO THE USE OF PROCEEDS FROM ANY SALE OF THE PROPERTY BY THE CITY; AND DECLARING AN EFFECTIVE DATE. Mr. Moore moved for adoption of the Resolution and Mr. Hart seconded the motion, which passed unanimously. The meeting adjourned at 11:08 p.m. on motion made by Mr. Guerra and seconded by Mr. Moore.
