assistance offered by the university, who would enhance the service based on the extended times. <br />Once the ordinance has been approved, the TABC will take all applications and approve them all <br />simultaneously at a certain point in time. It may be 45-60 days for a vendor to receive their <br />permit. No issues have been raised from EMS or the Central Texas Medical Center, but they will <br />track activity. The Task Force has also visited with the Police Department regarding shifts and <br />overtime. <br />Councilmember Jones added that a formal report will be brought back to Council with <br />recommendations in January 2010. <br />Council directed staff to move forward with the ordinance, and to include a review by Council at <br />six and twelve months, and two years. <br />17. Update on the Havs Caldwell Public Utility A6ency. <br />Graham Moore, Lockwood, Andrews and Newnam Engineers, agency manager, reported there <br />was a study done, which concluded in March 2005. They identified the development of a <br />groundwater project in the Carrizo-Wilcox aquifer for the ultimate supply. It was agreed to share <br />supplies to meet interim shortages. The Hays Caldwell Public Utility Agency was created in <br />January 2007. Participants are the Cities of Kyle, Buda, and the Canyon Regional Water <br />Authority. There is a thirteen-member board. <br />18. Discussion on proposed Pro-rata Assessment Ordinance, and provide direction to staff. <br />This item was brought forward at 6:00 p.m. <br />• Chuck Swallow, Director of Development Services, stated the intent of the proposed ordinance is <br />to provide a method to reimburse a developer for the cost of extending water or sewer lines to <br />properties that extend past or through other benefiting properties. Any developer who is <br />extending public utilities to the existing system can receive the reimbursement. Conditions <br />include: 1) any pro-rata utility line must be approved by the City Council; 2) only the <br />construction costs are eligible for a pro-rata assessment; and 3) the pro-rata assessment period is <br />limited to 10 years from the completion of construction. The best time for the City to track this <br />is when the property is platted, or if platting not required, then at the time of permitting. The City <br />will retain 2% of the assessment amount to cover administrative costs. The City will reimburse <br />assessments to the developer within ninety days of collection. <br />Council directed staff to continue with this and bring back to Council. <br />19. Report on the Green Cities Conference by Councilmember Porterfield. <br />Councilmember Kim Porterfield reported on the Green Cites Conference she attended in <br />Portland, Oregon. <br />20.
