B. Right to Amend or Withdraw RFP <br />DSHS reserves the rights to alter, amend, or modify any provisions of this <br />RFP or to withdraw this RFP at any time prior to the execution of a contract if <br />it is in the best interest of DSHS and the State of Texas. The decision of <br />DSHS is administratively final. Amendment or withdrawal of the RFP will be <br />posted to the ESBD. <br />C. Authority to Bind DSHS <br />For the purposes of this RFP, the Commissioner of DSHS, Assistant <br />Commissioner, Chief Financial Officer or Chief Operating Officer, CSCU <br />Director, or the employee designated through commissioner's directive <br />relating to line of authority (CD-2005.02) to act in place of one of those <br />employees is granted the signature responsibility of that employee are the <br />only individuals who may legally commit DSHS to the expenditure of public <br />funds under the contract. No costs chargeable to the proposed contract will <br />be reimbursed before the contract is fully executed. <br />D. Financial and Administrative Requirements <br />General Provisions <br />1. All contractors under this RFP must comply with the DSHS General <br />Provisions posted on the ESBD with this RFP. The General Provisions <br />are also located at: http://www.dshs.state.tx.us/grants/gen- <br />prov.shtm. <br />Respondent is not required to return the General Provisions or DSHS <br />Assurances and Certifications with their proposal. By signing the Form <br />A: Face Page, respondent is agreeing to abide by the referenced <br />general provisions and DSHS Assurances and Certifications. <br />2. All contractors must comply with the cost principles, audit <br />requirements, and administrative requirements. The Financial and <br />Administrative Requirements are reflected on Form L. Financial <br />Management and Administrative Questionnaire. <br />Additional requirements on basic accounting and financial <br />management systems are found in DSHS Contractor Financial <br />Procedures Manual. Copies of the procedures manual are available <br />online at http://www.dshs.state.tx.us/contracts/docs/cfpm.doc. <br />OMB Circulars may be found at: <br />hftp://www.whitehouse.aov/omb/circulars/. <br />All DSHS contractors are required to maintain a financial management <br />system that will identify the receipt and expenditure of funds separately <br />for each DSHS contract and/or program attachment and will record <br />expenditures by the budget cost categories in the approved budget for <br />Page 22 RFP# EMS/LPG - 0328.1
