eligibility conditions to the stated criteria listed above at the time the proposal is <br />submitted. Respondent must continue to meet these conditions throughout the <br />selection and funding process. DSHS expressly reserves the right to review and <br />analyze the documentation submitted and to request additional documentation, and <br />determine the respondent's eligibility to compete for the contract award. <br />B. Contract Term <br />It is expected that the initial contract period will begin on or about 10/01/09, <br />and will be made for a 11-month budget period. <br />Projects may not start prior to the effective date of the contract. <br />Contracts awarded under this RFP and any anticipated contract renewals are <br />contingent upon the continued availability of funding. DSHS reserves the <br />right to alter, amend or withdraw this RFP at any time prior to the execution of <br />a contract if funds become unavailable through lack of appropriations, budget <br />cuts, transfer of funds between programs or agencies, amendment of the <br />appropriations act, health and human services agency consolidations, or any <br />other disruption of current appropriations. If a contract has been fully <br />executed and these circumstances arise, the provisions of the Termination <br />Article in the contract General Provisions will apply. <br />C. Use of Funds <br />In Fiscal Year 2010, approximately $1 million is expected to be available to <br />fund LPG contracts. The specific dollar amount awarded to each successful <br />respondent depends upon the merit and scope of the proposal and other best <br />value considerations. <br />Funds are awarded for the purpose specifically defined in this RFP and must <br />not be used for any other purpose. Funds must not be used to supplant local, <br />state, or federal funds. (Note: Supplanting is the result of any funds <br />being removed from a budget due to receipt of this grant, but does not <br />include matching funds). See Section I. Introduction, Definitions. For more <br />information about allowable use of funds see Section II. Program Information, <br />F. Funding Preferences and Limits. <br />Funds must not be used for projects that result in a duplication of services. <br />Nor can they be used for disposable supplies/equipment (handouts, copies, <br />gloves, syringes), salaries, fringe benefits, capital projects (building projects), <br />travel, food, indirect costs, day-to-day operating expenses (e.g. fuel, <br />insurance, loan payments, rent, stocks, bonds), land purchases, projects not <br />feasible for an organization to implement or projects not consistent with the <br />respondent's mission. <br />Page 8 RFP# EMS/LPG - 0328.1
