RESOLUTION NO. 2009-65R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />SUPPORTING THE PASSAGE OF SENATE BILL 855 PENDING BEFORE THE <br />TEXAS LEGISLATURE, THE TEXAS LOCAL OPTION TRANSPORTATION ACT; <br />AUTHORIZING THE MAYOR AND CITY MANAGER TO SIGN ANY LETTERS OR <br />MAKE ANY PUBLIC STATEMENTS INDICATING THE CITY'S SUPPORT FOR <br />SENATE BILL 855 CONSISTENT WITH THIS RESOLUTION; AND, PROVIDING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. Texas cities and counties are experiencing rapid growth creating transportation <br />demands that exceed existing capacity. <br />2. Such transportation demands are testing the limits of the existing transportation <br />infrastructure, causing congestion, unhealthy levels of vehicle emissions and a less safe <br />transportation network. <br />3. Funding for local transportation projects available from the Texas Department of <br />Transportation have steadily declined and cities and counties have limited options for raising the <br />revenue necessary to fund transportation projects to meet current and future demands. <br />• 4. Pending before the Texas legislature is Senate Bill 855 ("SB 855") which, if <br />enacted, would provide to certain Texas counties and cities additional sources of funding for <br />transportation projects. <br />5. SB 855 provides that the commissioners court of a county may call an election on <br />the issue of authorizing one or more funding methods for one or more mobility or transportation <br />improvement projects located in the county, including passenger rail, transit, roadway, and <br />freight rail projects. <br />6. The new transportation funding methods authorized under SB 855 include: <br />(a) a tax on the retail sale of motor vehicle fuel, at a rate not to exceed ten <br />cents per gallon; <br />(b) a mobility improvement fee in an amount not less than $1.00 or more than <br />$60.00 imposed on a person registering a motor vehicle; <br />(c) a parking management fee in an amount not to exceed $2.00 per day per <br />vehicle for use of a county or municipally owned parking space; <br />(d) an annual motor vehicle emissions fee based on the amount of pollutants <br />released by a vehicle, not less than $1.00 or more than $15.00;
