TRA\CE <br />12.9 Occupancy Restrictions <br />All dwelling units within the Multi Family areas on the Project Site shall be restricted to occupancy by <br />no more than two (z) persons not related by blood, legal adoption, marriage or conservatorship or <br />three (3) persons in a three bedroom unit not related by blood, legal adoption, marriage or <br />conservatorship. The provisions of this section shall be enforced through the residential lease <br />agreements and occupancy shall be based upon the lessee(s) indicated on the residential lease. No <br />units will be rented by the bedroom. Additionally, failure to enforce the provisions of this section shall <br />be considered a violation of this PDD. Single family residential shall meet all occupancy requirements <br />adopted in the City of San Marcos Land Development Code. <br />Covenants, Conditions and Restrictions shall be recorded and shall include a reference to the city's <br />occupancy restrictions within single - family zoned property. <br />M <br />
