Regular Meeting January 11, 1993 Page 3 Mayor Morris introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1992-1993 FISCAL YEAR TO PROVIDE FUNDING FOR UTILITY RELOCATION COSTS FOR THE LOOP 82 WIDENING PROJECT; AND DECLARING AN EMERGENCY. Mr. Moore moved for adoption of the Ordinance on emergency and Ms. Kissler seconded the motion. The Council requested information be provided to them regarding how much money has been spent by the City for this project and how much will be spent by the City. The Council voted unanimously for adoption of the Ordinance. Mayor Morris introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY CODE OF ETHICS TO PROVIDE FOR THE ADMINISTRATION OF OATHS AT HEARINGS OF THE ETHICS REVIEW COMMISSION; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR PENALTIES; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE.~ Mr. Moore moved for approval of the Ordinance on first reading and Ms. Kissler seconded the motion. Mike Gividen stated he thinks this amendment is not needed, and will prohibit free speech. Lisa Coppaletta thinks people will be afraid to speak with the oath process. She stated she would like to be appointed to the Ethics Review Commission to give the commission an independent voice. Dan Scales stated the City Attorney's view is the City Manager's viewpoint. The Council voted unanimously for approval of the Ordinance on first reading. Mayor Morris introduced for consideration approval of minutes of the Regular Meeting held December 14, 1992 and the Special Meeting held December 21, 1992, approval of an Ordinance on second reading and adoption of five Resolutions on consensus. The Council removed Item 8.C. (5) to be considered separately. Ms. Kissler moved for approval of the minutes of the Regular Meeting held December 14, 1992 and the Special Meeting held December 21, 1992 (Ms. Kissler and Mr. Guerra abstaining), for approval of the Ordinance on second reading and for adoption of the remaining four Resolutions on consensus and Mr. Plummet seconded the motion, which passed unanimously. The captions of the Ordinance and Resolutions read as follows: Approval of Ordinance on second reading: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, REVISING CHAPTER 15, LIBRARY, OF THE SAN MARCOS CODE OF ORDINANCES TO PROVIDE FOR CERTAIN SERVICE FEES TO BE SET BY THE CITY COUNCIL; SETTING THE AMOUNTS OF THESE FEES; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. Adoption of Resolutions: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LETTER AGREEMENT BETWEEN THE CITY AND NATIONAL ENVIRONMENTAL TESTING, INC. TO EXTEND THE TERM OF THE ANALYTICAL SERVICES CONTRACT EFFECTIVE FEBRUARY 1', 1993; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY AND DECLARING AN.EFFECTIVE DATE. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING FINAL PAYMENT TO D. L. BANDY CONSTRUCTORS FOR COMPLETION OF THE CONSTRUCTION OF A RESTROOM BUILDING IN CHILDREN'S PARK; ACCEPTING THE PROJECT FOR USE BY THE CITY; AUTHORIZING FINAL PAYMENT IN THE AMOUNT.OF $2,136.00; AND DECLARING AN EFFECTIVE.DATE.
