<br />Regular Meeting December 7, 1992 Page 2 <br /> <br /> <br />Mr. Moore stated he would abstain from discussion and vote of this <br />matter because he serves as Chair of the Shuttle Bus Task Force. <br />Ms. Kissler moved for adoption of the Ordinance on third and final <br />reading and Mr. Hernandez seconded the motion. Ms. Kissler moved to <br />amend Section 3 to read, "That all Ordinances and Resolutions or <br />parts of Ordinances or Resolutions in conflict herewith are hereby <br />repealed; provided, that during the current term of the agreement <br />between Laidlaw, Inc. and Southwest Texas State University relating <br />to shuttle bus service, the provisions of City Ordinances 1984-44 - <br />and 1984-82 are saved from repeal, and such provisions are repealed ¡ <br />only after expiration of the current term of such agreement," and: <br />amend Section 5 to read, "That this Ordinance shall be in effect ten <br />(10) days from and after its passage; provided that this Ordinance <br />shall not take effect as to any existing intra-city bus service <br />serving Southwest Texas State University until the end of the <br />current term of any agreement between the operator of such a service <br />and the university; and this Ordinance shall be published in a <br />newspaper of general circulation in the City as required by the <br />Charter of the city of San Marcos, Texas," and Mayor Morris seconded <br />the motion, which passed unanimously. Mr. Hernandez requested <br />section 25-52(a) be read for everyone's clarification, which the <br />City Secretary read. Kenneth Luna, an SWT student, asked how the <br />I city arrived at 5%, and Mr. Gilley responded it is an average <br />, percentage of present franchises with the City plus some funding for <br />street repair. An actual cost will be determined and presented for <br />amendment to this Ordinance at a future time. Mr. Luna stated he is <br />opposed to the Ordinance. Christopher Cole asked Mr. Gilley about <br />the cost allocation study and what roads are being monitored. Mr. <br />Gilley stated data is being collected regarding volume, speed, <br />weight and core samples at bus stops. City streets that are part of <br />the bus route are being used to collect data. Mr. Cole requested <br />the City postpone adoption of the Ordinance until such time as the <br />study is complete. Michael Baccaselli requested a list of bus <br />companies. Lisa Coppoletta stated if there wasn't a bus operation, <br />there would be more vehicles on the streets and more wear and tear. <br />Dan Scales stated the students of SWT are the backbone of the City's <br />economy. Mr. Hernandez stated he wants the City to use a percentage <br />that is most accurate. Mr. Guerra stated he did not understand why <br />we are adopting the Ordinance before the data is gathered. Mr. Hart <br />stated he did not know why we need this Ordinance until such time as <br />we know what SWT will do in 1994. Mr. Guerra stated he wants to <br />table the Ordinance until we have all information needed. Mr. Hart <br />moved to table the Ordinance and Mr. Guerra seconded the motion. On <br />roll call the following vote was recorded: <br /> <br />AYE: Hernandez, Hart, Guerra. <br /> <br />NAY: Morris, Kissler. <br /> <br />ABSTAIN: Moore. <br /> <br />The motion failed. Mr. Gilley stated the City's study of this <br />matter began prior to Laidlaw's contract being extended. On roll <br />call for adoption of the Ordinance on third and final reading, the <br />following vote was recorded: <br /> <br />AYE: Morris, Kissler. <br /> <br />NAY: Hernandez, Hart, Guerra. <br /> <br />ABSTAIN: Moore. <br /> <br />The motion failed. <br /> <br />Mayor Morris introduced for consideration reconsideration of two <br />Zoning Ordinances. The Council did not wish to reconsider the <br />Ordinances. The captions read as follows: <br />
