<br />85 <br /> <br /> <br /> <br />Regular Meeting January 13, 1992 Page 2 <br /> <br /> <br />DEFINITIONS FOR TOURIST COURT AND USED CAR LOT IN SECTION 4; <br />CHANGING THE TERMS "DIRECTOR OF PLANNING" AND "PLANNING <br />DIRECTOR" TO READ "DIRECTOR" THROUGHOUT THE ORDINANCE; TO <br />DELETE THE "OP" OFFICE AND PROFESSIONAL DISTRICT DESIGNATION <br />AND TO ADD THE "LB" LIMITED BUSINESS DISTRICT DESIGNATION IN <br />SECTION 5(B), NEW DISTRICTS; AMENDING SECTION 25(A), "M" <br />SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT <br />REGARDING THE ISSUANCE OF BUILDING AND SITE DEVELOPMENT PERMITS <br />AND TO ADD AND DELETE CERTAIN PERMITTED USES; ADDING VETERINARY <br />SERVICES IN SECTION 29(B) (7); ADDING VETERINARY SERVICES AS <br />SPECIFIC AND PERMITTED USES IN SECTION 30(A) AND (B); AMENDING <br />SECTION 39(C) AND (D) WITH REGARD TO NONCONFORMING USES; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING <br />ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak for or against the amendments. Nina pryatel asked if the same <br />number of people wAS being notified of zoning changes as previously, <br />and Mr. Patterson advised her yes. Mrs. pryatel asked what had been <br />said about "kennel", and Mr. Taylor advised her it was now being <br />defined. No one else wished to speak, so Mayor Morris closed the <br />public hearing. Mr. Moore moved for approval of the Ordinance on <br />first reading and Mr. Guerra seconded the motion. Ron Patterson <br />advised the Council the "LB District" was to allow limited <br />commercial usage in a primarily residential area. He advised a <br />veterinary clinic needs an s.u.p. permit in an LB District, and a <br />Commercial District does not. The Council voted unanimously for <br />approval of the Ordinance on first reading. <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING <br />LOTS 1-A AND 1-B, BLOCK 2 OF THE RESUBDIVISION OF THE C. L. <br />MCGEHEE SUBDIVISION RECORDED IN VOLUME H, PAGE 573 OF THE HAYS <br />COUNTY DEED RECORDS, ALSO KNOWN AS BASS PLACE, SAN MARCOS, HAYS <br />COUNTY, TEXAS, AS RECORDED IN VOLUME 3, PAGE 296 OF THE HAYS <br />COUNTY PLAT RECORDS; LOTS 1-C, 2-A, 2-B AND 2-C, BLOCK 2 OF THE <br />RESUBDIVISION OF THE C. L. MCGEHEE SUBDIVISION, RECORDED IN <br />VOLUME H, PAGE 573 OF THE HAYS COUNTY DEED RECORDS, ALSO KNOWN <br />AS BASS PLACE, SAN MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN <br />VOLUME 2, PAGE 329 OF THE HAYS COUNTY PLAT RECORDS, AND LOT 3, <br />BLOCK 2 OF THE C. L. MCGEHEE SUBDIVISION, AS RECORDED IN VOLUME <br />H, PAGE 573 OF THE HAYS COUNTY DEED RECORDS, LOCATED AT 610, <br />612 AND 618 W. HUTCHISON STREET, FROM "R-1" (SINGLE-FAMILY <br />DWELLING DISTRICT [LOW DENSITY]) AND "TH-2" (TOWNHOUSE <br />RESIDENTIAL DISTRICT [MEDIUM DENSITY]) TO "MF-1" (MULTI-FAMILY <br />DISTRICT [LOW DENSITY]) AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Hart stated he would abstain on this matter, as he does business <br />with the applicant. Mayor Morris opened the public hearing and <br />asked if anyone wished to speak for or against the amendment. No <br />one wished to speak, so Mayor Morris closed the public hearing. Mr. <br />Guerra moved for adoption of the Zoning Ordinance and Mr. Moore <br />seconded the motion.
