<br /> -5- <br /> 5. Amend Section 4.02 as follows: <br /> Sec. 4.02. City secretary. <br /> <br /> The city council shall appoint the city secretary, and such <br /> assistant city secretaries as the city council shall deem <br /> advisable. The city secretary, or an assistant city <br /> secretary, shall give notice of council meetings, shall keep <br /> the minutes of the proceedings of such meetings, shall <br /> authenticate by signature and record in full in û booJe kept <br /> anà indexed for the purpoûe, all ordinances and resolutions, <br /> and shall perform such other duties as the city manager, with <br /> the consent of the city council, shall assign and those <br /> elsewhere provided for in this charter. <br /> This wording change will allow the City Secretary the flexibility <br /> of using records storage methods for ordinances and resolutions <br /> other than the cumbersome minute books. <br /> 6. Amend Sec. 5.03 as follows: <br /> Sec. 5.03. Filing for office. <br /> <br /> Any qualified person who desires to become a candidate for <br /> election to a place on the city council shall file with the <br /> §í![ljj¡::::¡¡ìBI!i/ç@.ly mayor at least ¡I§!!;y¥f;:!yl, thirty :¡:(}1:§:~::+*T days <br /> Pfí6f""""tB""""fhe-""election day an aþþITÒátT6h for his"""""oF her name <br /> to appear on the ballot. Such application shall clearly <br /> designate the place on the council to which the candidate <br /> seeks election and shall contain the candidate's sworn <br /> statement of compliance with the qualification for holding the <br /> office sought under the laws of Texas and the provisions of <br /> this charter. <br /> Both of these changes will make this section comport with the State <br /> Election Code. <br /> The filing of candidate applications with the city secretary is a <br /> natural extension of the ministerial election duties of that <br /> position. <br /> The 45-day deadline for candidate applications to be placed on the <br /> City ballot will give effect to new provisions of the Election Code <br /> requiring write-in candidates to make written candidacy <br /> declarations no later than 30 days before election day. <br />
