The Council then voted unanimously for <br />approval of the Ordinance on first reading. <br /> <br />Mayor Morris introduced for consideration adoption of an <br />ordinance on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS DISANNEXING 198.80 ACRES OF LAND, MORE OR <br />LESS, IN THE THOMAS H. FORSITH, BENJAMIN J. WHITE, LYDIA <br />GLASCOW, JOHN MAXAMILLON AND PATRICK MCGREAL SURVEYS IN <br />HAYS COUNTY, TEXAS, IJOCATED ALONG RANCH ROAD 12, FROM THE <br />TERRITORIAL LIMITS OF THE CITY; DECLARING AN EMERGENCY; <br />AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Moore moved for adoption of the Ordinance on emergency and <br />Mr. Hernandez seconded the motion. Mayor Morris questioned <br />Mr. Gilley regarding the exact impact this would be on the city <br />limits and the extraterritorial jurisdiction. Mr. Gilley <br />stated that about 5,200 acres would be eliminated from the <br />extraterritorial jurisdiction. Mr. Gilley stated this was a <br />City-initiated disannexation. Mayor Morris asked if the impact <br />on the city limits was just 198.80 acres and Mr. Gilley stated <br />that was correct. Mr. Gilley stated this would reduce the ad <br />valorem taxes in that area of about $6,800.00. On roll call <br />the following vote was recorded: <br /> <br />AYE: Hernandez, Hart, Guerra, Kissler, Plummer. <br /> <br />NAY: Morris, Moore. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Morris introduced for consideration adoption of a <br />Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN <br />AGREEMENT BETWEEN THE CITY AND THE HERITAGE ASSOCIATION OF <br />SAN MARCOS, INC. FOR THE CHARLES S. COCK MUSEUM; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for adoption of the Resolution and Mr. Moore <br />seconded the motion. Mayor Morris asked the Council if they <br />had any discussion on this. Mr. Hernandez asked Mr. Cobb what <br />the terms and conditions where regarding having food in the <br />Cock House. Mr. Cobb stated under the current agreement, the <br />Heritage Association would provide the food for any special <br />event or function. The charges for the food would depend on <br />the requested menu. Mr. Plummer asked what the average price <br />would be for a dinner. Mr. Bill Daniels stated an average <br />dinner would be much like the luncheons which was $5.00 per <br />person. Ms. Kissler asked about items such as cookies and <br />punch, and Mr. Daniels stated it would be approximately $2.00 <br />or $2.50 per person. Mr. Hart asked if a group could build <br />their own menu based on affordability. Mr. Daniels stated they <br />work with each group individually. Ms. Frances Stovall stated <br />a three-course dinner with appetizers and coffee would run <br />$7.50 at the most. Mr. Hernandez asked what was the problem <br />with another catering service using the facility since the <br />Heritage Association had someone on the premise at all times. <br />Ms. Stovall stated there was no problem, but Heritage <br />Association took the pride and the responsibility of the upkeep <br />on the house due to the valuable antiques and furniture in the <br />house. The Heritage Association did not charge for. the use of <br />the house, simply the food and drinks they catered. Mr. Lupe <br />Carbajal stated he did not agree with the fact the city <br />building could not be used unless someone catered through the <br />Heritage Association. Other people in the community should be <br />able to bring food into the building and clean up after <br />
