159 Regular Meeting August 24, 1992 Page 4 title to read, "TERMINATION;" first page of contract document to read, "THIS CONTRACT, made and entered into this day of , 19--, by and between the City of San MarëõS, Texas, a Municipal Corporation of Hays County, Texas (hereinafter called the "City") and Browning-Ferris, Inc. (hereinafter called "Contractor"); on first page of Contract in paragraph 1. to read, "The Contractor shall furnish all personnel. . . .;" the signature lines of the Contract to read, "CITY OF SAN MARCOS, TEXAS, a Municipal Corporation of Hays County, Texas, By Larry D. Gilley, City Manager and Attest Janis K. Womack, City Secretary" and "Browning-Ferris, Inc. By (Printed Name) and (Title) and Attest by Secretary", and Mr. Guerra seconded Mayor Morris' amendments, which passed unanimously. The Council then voted unanimously for adoption of the Resolution. Mayor Morris introduced for consideration a public hearing and approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 12-8 OF THE SAN MARCOS CODE OF ORDINANCES TO PROVIDE FOR SETTING OF THE RESIDENTIAL SOLID WASTE COLLECTION RATE, AND OF THE PORTION OF SUCH RATE TO BE DEPOSITED INTO THE SOLID WASTE RESERVE FUND, BY SEPARATE ORDINANCE; DECREASING THE RESIDENTIAL SOLID WASTE COLLECTION RATE BASED ON THE CONTRACT COLLECTION RATE FOR BROWNING-FERRIS INDUSTRIES, INC.; SETTING THE AMOUNT OF THE SOLID WASTE COLLECTION RATE TO BE DEPOSITED INTO THE SOLID WASTE RESERVE FUND; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION; AND DECLARING AN EFFECTIVE DATE. Mayor Morris opened the public hearing and asked if anyone wished to speak. No one did, so Mayor Morris closed the public hearing. Mr. Moore moved for approval of the Ordinance on first reading and Mr. Plummer seconded the motion. Mr. Taylor advised the total charge was being reduced from $8.23 to $8.04. The Council voted unanimously for approval of the Ordinance on first reading. Mayor Morris introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1991-1992 FISCAL YEAR TO PROVIDE THE CITY'S MATCHING FUNDS FOR A FEDERAL AVIATION ADMINISTRATION GRANT FOR PROJECT NO. 3-48-0195-09 AT THE SAN MARCOS MUNICIPAL AIRPORT; AND DECLARING AN EMERGENCY. Mr. Plummer moved for adoption of the Ordinance on emergency and Mr. Moore seconded the motion. The Council was advised this project is for the rehabilitation of a parking apron. The Council voted unanimously for adoption of the Ordinance on emergency. Mayor Morris introduced for consideration reconsideration of Zoning Ordinances. The Council did not wish to reconsider any of these Ordinances. The captions of these Ordinances read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING 15.846 ACRES OF LAND OUT OF THE J. M. VERAMENDI SURVEY NO.2, IN HAYS COUNTY, TEXAS, SAME BIENG ALL OF THAT CERTAIN 5.51 ACRE TRACT OF LAND CONVEYED TO MCCOY CORPORATION BY DEED RECORDED IN VOLUME 235, PAGE 107 OF THE HAYS COUNTY DEED RECORDS AND ALL OF THAT CERTAIN 10 ACRES OF LAND CONVEYED TO MCCOY CORPORATION BY DEED RECORDED IN VOLUME 284, PAGE 9 OF THE DEED RECORDS OF HAYS COUNTY, LOCATED AT 1200 IH-35 NORTH FROM "I" (INDUSTRIAL DISTRICT) TO "CO (COMMERCIAL DISTRICT) AND DECLARING AN EFFECTIVE DATE.
