<br /> 3 <br /> Special Meeting September 8, 1992 Page 3 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING SECTIONS 12-8 OF THE SAN MARCOS <br /> CODE OF ORDINANCES TO PROVIDE FOR SETTING OF THE <br /> RESIDENTIAL SOLID WASTE COLLECTION RATE, AND OF THE <br /> PORTION OF SUCH RATE TO BE DEPOSITED INTO THE SOLID WASTE <br /> RESERVE FUND, BY SEPARATE ORDINANCE; DECREASING THE <br /> RESIDENTIAL SOLID WASTE COLLECTION RATE BASED ON THE <br /> CONTRACT COLLECTION RATE FOR BROWNING-FERRIS INDUSTRIES, <br /> INC.; SETTING THE AMOUNT OF THE SOLID WASTE COLLECTION <br /> RATE TO BE DEPOSITED INTO THE SOLID WASTE RESERVE FUND; <br /> PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING <br /> ORDINANCES; PROVIDING FOR PUBLICATION; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> Mr. Plummer moved for approval of the Ordinance on second <br /> reading and Mr. Moore seconded the motion, which passed <br /> unanimously. <br /> Mayor Morris opened the question and answer session with press <br /> and public. Council Member Rick Hernandez stated the School <br /> District had plans to close Broadway between Hwy. 123 and FM <br /> 621 and make it into a parking lot. Mr. Hernandez was <br /> concerned this will create a bad situation for traffic flow <br /> from the Wallace Addition, River Road, FM 621 to DeZavala, and <br /> Highway 123. Mr. Hernandez stated the Superintendent for the <br /> SMCISD, approached the State to try to receive funds to improve <br /> the road or to take the road as a State road. Neither the <br /> State nor the City will not take it. Mayor Morris suggested <br /> the City try to get with the State to redesign the 5-point <br /> location to be a more workable intersection. Mr. Gilley <br /> suggested submitting a Resolution to the State to try to get <br /> the 5-point intersection. Mr. Moore suggested that the City, <br /> State, and School get together and put money on the table to <br /> try to solve the problem. Mayor Morris directed Mr. Gilley to <br /> contact the State to see if they will revisit the situation. <br /> Mr. Hernandez then questioned Mr. Gilley regarding the cost of <br /> building shelters for children waiting on buses, perhaps in <br /> parks and residential areas. Mr. Gilley stated he would get a <br /> per-unit cost for the shelter. Mr. Gilley gave special thanks <br /> to the Council and staff for a extremely successful budget <br /> process. Mayor Morris also thanked Mr. Gilley and the staff <br /> for an outstanding job. <br /> Mayor Morris introduced an Executive Session pursuant to <br /> Article 6252-17, section 2(e), V.A.C.S., to discuss pending <br /> litigation (Sierra Club vs. Lujan; GBRA vs. Texas Water <br /> Commission).
