Justin <br />Butts, student at SWT, asked if the Council would lower the <br />working figure to 1% rather than 5%. Mayor Morris stated the <br />Ordinance sets a policy whereby the Council can negotiate or <br />charge a for-profit bus service on city streets. Mr. Hart <br />stated that until the Council has an exact figure, any percent <br />would not reflect the actual cost. Mr. Gilley stated the 5% <br />fee was based on the standard for other utility franchise fee <br />dates. Mr. Butts asked the Council to consider changing the 5% <br />to a lower percentage or to state in the Ordinance that the tax <br />would only provide for an increase for the amount of the cost <br />of service increase, and postpone the third reading in order to <br />get citizens of San Marcos, student officials from the' <br />University, and students together to discuss these fees. Mayor <br />Morris stated she has been on SWT radio talking about the <br />shuttle bus and encouraged the students to engage in a <br />community discussion of this matter. John Dimery, Amy Acord, <br />Michael Bocconcelli, and Sergio Ray, students at Southwest <br />Texas State University, addressed the Council with questions <br />and their concerns regarding the implementation of this <br />Ordinance. Sharlene Walter, assistant manager with an <br />apartment complex in town, stated their property was just, <br />repaved where the garbage disposal trucks work, and not the <br />shuttle buses. Mayor Morris stated the garbage trucks contract <br />with the apartments, and semi-trucks and garbage trucks also <br />pay their taxes. Mayor Morris asked if the shuttle buses <br />stopped at all apartment complexes, and Ms. Walter stated the <br />buses stop at areas which are general facinity for several <br />complexes. Mayor Morris asked the Council if they had any <br />discussion. Mr. Guerra made a motion to amend the Ordinance in <br />Sec. 25-52 (a) to read" . . . established at 1% of the gross <br />receipts of the service." Motion failed due to lack of a <br />second. Mr. Hart made a motion for Sec. 25-52 (a) to add" . . <br />. 5% of the gross receipts of the ,service or whatever percent <br />most accurately reflects the cities cost allocation. Mr. <br />Guerra seconded the motion. Ms. Kissler introduced Item 4. <br />Ms. Kissler introduced for consideration adoption of an <br />Ordinance on emergency, the caption which was read as follows:-' <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY <br />OF SAN MARCOS, TEXAS, GENERAL OBLIGATION BONDS, SERIES <br />1992-A, IN THE AGGREGATE PRINCIPAL AMOUNT OF $4,600,000; <br />PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR THE <br />SECURITY FOR AND PAYMENT OF SAID BONDS; AWARDING THE SALE <br />THEREOF; APPROVING THE OFFICIAL STATEMENT; ENACTING OTHER <br />PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN <br />EMERGENCY. <br />. <br />
