<br /> 131 <br />Regular Meeting November 23, 1992 Page 7 <br />Mr. Moore moved for adoption of the Ordinance on emergency and <br />Mr. Plummer seconded the motion. Mr. Guerra moved to amend the <br />Ordinance read into the record by Rick Fisher as follows: <br />"Page 5: to add the interest rates 1993 through 1999 - 8.20%, <br />2000 - 7.25%, 2001 - 5.20%, 2002 - 5.25%, 2003 - 5.40%, 2004 - <br />5.60%, 2005 - 5.70%, 2006 through 2008 - 5.25%", and on Page <br />22, Article VII, section 7.01. (a) to add the name of <br />"Prudential Securities Incorporated" and a premium of "$-0-", <br />and Mr. Moore seconded the motion , which passed unanimously. <br />The Council then voted unanimously for adoption of the <br />Ordinance on emergency. <br />Ms. Kissler introduced a discussion regarding pursuing a grant <br />proposal for matching funds for Collection System <br />Rehabilitation CIP Project and direction to staff. Stephen <br />Jenkins stated this grant was to address non-point source <br />pollution. Mr. Jenkins stated the City qualifies in two areas <br />for sewer system rehabilitation. for Hays County and the San <br />Marcos River. Ms. Kissler asked if the city had matching funds <br />and Mr. Jenkins stated yes. Mr. Gilley stated there was a <br />deadline of November 30,1992, and the staff needed direction <br />from the Council. Mr. Moore asked if Mr. Jenkins had a target <br />area and Mr. Jenkins stated the City would like to assess as <br />much of the system as possible, especially in the area of the <br />collection system on the recharge and some areas on the <br />transition zone. Mr. Jenkins also stated this would be a <br />combination of smoke testing, television, and other methods of <br />assessment. The Council directed the staff to go forward with <br />pursuing the grant proposal. <br />Ms. Kissler introduced the City Manager's report. (1) Mr. <br />Gilley stated Mr. Jenkins had been invited to participate in an <br />EPA sponsored program called "Water for People" in Poland to <br />serve as an instructor in that program. Mr. Jenkins stated <br />this was a branch of the American Waterworks Association and he <br />would be in Poland for two weeks. (2) Mr. Hernandez presented <br />some suggestions that citizens had regarding the cost in hiring <br />a new police chief. Several citizens suggested hiring from <br />within the department and also to scrutinize the cost of <br />advertising. <br />Ms. Kissler introduced the City Attorney's Report. Mr. Taylor <br />stated he would be giving some information regarding the Sierra <br />Club lawsuit in executive session. The Judge felt he would <br />have a decision by December 11, 1992. <br />Ms. Kissler introduced the City Council's Report. The Council <br />had no report. <br />Mayor Morris introduced an Executive Session pursuant to <br />Article 6252-17, sections 2(e) and (f), V.A.C.S., to discuss <br />pending litigation (sierra Club vs. Lujan), contemplated <br />litigation, matters where the city Attorney's ethical duty to <br />the city clearly conflicts with Article 6252-17; purchase of <br />real property and negotiated contracts for prospective gifts or <br />donations to the city, respectively. Mr. Moore made a motion <br />to adjourn into Executive Session at 10:03 p.m. and Mr. <br />Hernandez seconded the motion, which passed unanimously. <br />Ms. Kissler made a motion to reconvene from Executive Session <br />at 11:45 and Mr. Moore seconded the motion, which passed <br />unanimously. <br />The meeting adjourned at 11:46 p.m. on motion made by Mr. <br />Hernandez and seconded by Ms. Kissler. <br /> ~ tJ1~~ <br /> Mayor <br />
