<br />103 <br /> <br /> <br /> <br />Regular Meeting November 9, 1992 Page 4 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING <br />LOTS 1-6 OF THE ORIGINAL ARRANGEMENT OF BLOCK 2 OF BROWNS <br />SUBDIVISION IN THE CITY OF SAN MARCOS, TEXAS, AS RECORDED IN <br />VOLUME 2, PAGE 387 OF THE HAYS COUNTY PLAT RECORDS, LOCATED AT <br />1301-1308 CONWAY DRIVE, FROM "c" (COMMERCIAL DISTRICT) TO <br />"DP-2" (TWO-FAMILY DWELLING DISTRICT [MEDIUM DENSITY]) AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak for or against the zoning amendment. No one did, so Mayor <br />Morris closed the public hearing. Mr. Hernandez moved for adoption <br />of the Ordinance and Mr. Plummer seconded the motion, which passed <br />unanimously. <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1992-1993 <br />FISCAL YEAR TO PROVIDE FUNDING FOR THE DEMOLITION PROJECT AT <br />THE SAN MARCOS MUNICIPAL AIRPORT AND DECLARING AN EMERGENCY. <br />~ <br /> <br />Mr. Moore moved for adoption of the Ordinance on emergency and Ms. <br />Kissler seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1992-1993 <br />FISCAL YEAR TO PROVIDE CAPITAL IMPROVEMENT PROGRAM FUNDING FOR <br />THE CEMETERY CHAPEL RESTORATION; AND DECLARING AN EMERGENCY. <br />¡ <br />Ms. Kissler moved for adoption of the Ordinance on emergency and Mr. <br />Moore seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, SETTING A FEE FOR THE USE OF ANY STREET, ALLEY, HIGHWAY <br />OR GROUNDS OF THE CITY BY ANY PERSONS OPERATING A BUS <br />SERVICE PRIMARILY WITHIN THE CITY THAT DOES NOT HAVE A <br />FRANCHISE AGREEMENT WITH THE CITY; PROVIDING FOR THE TERMS AND <br />CONDITIONS OF THE PAYMENT OF SUCH FEE; PROHIBITING THE USE OF <br />ANY STREET, ALLEY, HIGHWAY OR GROUNDS OF THE CITY BY SUCH A <br />SERVICE UNLESS THIS FEE IS PAID; PROVIDING FOR SEVERABILITY; <br />REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; <br />PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Moore stated he would abstain from the discussion and vote of <br />this item. Mr. Plummer moved for approval of the Ordinance on first <br />reading and Mr. Hart seconded the motion. Mr. Gilley stated the 5% <br />of gross receipts street use fee is a preliminary recommendation <br />from Staff because of the wear and tear on city streets. The ~ <br />Council has requested the actual cost to the City, and Mr. Gilley <br />advised the Council he has requested the assistance of the State, <br />which will take approximately 60 days and Staff is conducting <br />traffic counts. Mr. Gilley stated the purpose of beginning the <br />readings of the Ordinance is to get the Ordinance in place and <br />provide the bidders for the shuttle bus service time to include this <br />in their bids to SWT. Mr. Guerra stated the students should be <br />allowed to speak on this Ordinance. Sam Woods, a graduate student <br />at SWT, provided the Council a handout of his analysis of SWT's <br />operation and information he has gathered how other universities <br />handle this matter.
