<br />105 <br />Regular Meeting November 9, 1992 Page 6 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING FINAL PAYMENT TO MANNIX CONSTRUCTION COMPANY <br /> FOR THE DEMOLITION OF BUILDINGS LOCATED AT THE SAN MARCOS <br /> MUNICIPAL AIRPORT; ACCEPTING THE PROJECT AS COMPLETE; <br /> AUTHORIZING FINAL PAYMENT IN THE AMOUNT OF $41,764.00; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT <br /> BETWEEN THE CITY AND TOM WILLIAMS FOR THE LEASE OF PROPERTY AT <br /> THE SAN MARCOS MUNICIPAL AIRPORT; AUTHORIZING THE CITY MANAGER <br /> TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND DECLARING <br /> AN EFFECTIVE DATE. <br />Mayor Morris introduced for consideration the appeal by Industrial <br />Solvents of a citation issued for failing to sample waste discharge <br />in June, 1992, and submit results to the City as required by Permit <br />8902-01. Mr. Bill Haney provided the Council with a letter and <br />prepared packet, and stated he was not satisfied with the city's <br />sampling of their wastewater. Mr. Haney asked to be waived from the <br />testing and be reclassified and is requesting the City set aside his <br />$2,900.00 fine. Mr. Haney stated the testing requirements are in <br />the Federal Regulations. Mayor Morris stated pollùtants have been <br />found in Mr. Haney's system. Mr. Haney stated he does not have <br />problems with all of the City's Ordinance but does have problems <br />with the Industrial Waste Permit and was unable to sample because of <br />their low flow. Mr. Boeker stated the City installed a sampling <br />port in June so the sampling could be done. He said EPA has <br />reviewed the City's Ordinance and the city's Policies and <br />Procedures, and Mr. Haney is not in compliance because he has <br />refused to sample. Mr. Haney has the option to dispose of wastes <br />off-site and show proof of manifest in lieu of sampling. Mayor <br />Morris moved to deny the appeal and Ms. Kissler seconded the motion, <br />which passed unanimously. ¡ <br />Mr. Goodwin of Goodwin Snack Sales, who previously provided vending <br />services to the City (Item 7.C.[3] earlier on the agenda), requested <br />permission to address the Council for clarification and indicated he <br />did not feel he had defaulted the contract. He was advised his <br />service had been cancelled because the standard of machines and <br />service was lacking, and there had been numerous complaints. <br />Mayor Morris introduced for consideration award of bid for the <br />Thorpe Lane Reconstruction Repairs capital Improvements Project. <br />Mr. Guerra moved to award bid to Du-Mor Enterprises, Inc. in the <br />amount of $57,264.00 and Mr. Moore seconded the motion, which passed <br />unanimously. <br />Mayor Morris introduced for consideration award of bid for water <br />meters for the Public Works Department. Mr. Guerra moved to award <br />bid to G. A. Powers Company of San Marcos, Texas in the amount of <br />$33,664.50 and Ms. Kissler seconded the motion, which passed <br />unanimously. <br />Mayor Morris introduced for consideration award of bid for vending <br />services for the City Offices. Mr. Guerra moved to award bid to AVS <br />Food Service of Buda, Texas for a 15.07% commission for a period ( <br />from November 14, 1992 through November 13, 1993 and Mr. Moore <br />seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration award of bid for the East <br />Side Interceptor Capital Improvements Project. Mr. Guerra moved to <br />award bid to William H. Gray Construction of Houston, Texas in the <br />amount of $1,296,117.00 and Moore seconded the motion, which passed <br />unanimously. <br />
