City Council Meeting Minutes January 19,2016 <br /> Recused: 1 - Council Member Gregson <br /> Main Motion: to approve Resolution 2016-08R as amended. The motion <br /> carried by the following vote: <br /> For: 6- Mayor Guerrero, Mayor Pro-Tern Thomaides, Council Member Prather, Deputy <br /> Mayor Pro Tern Prewitt, Council Member Hughson and Council Member Derrick <br /> Against: 0 <br /> Recused: 1 - Council Member Gregson <br /> PUBLIC HEARINGS - 7:00 PM <br /> 10. 7:00PM Receive a Staff presentation and hold a Public Hearing to receive comments <br /> for or against a request by Robert H. Jett to appeal a decision made at the December <br /> 8, 2015 Planning and Zoning Commission meeting, in which the Planning and Zoning <br /> Commission granted a Conditional Use Permit (CUP-15-38) for the sale of mixed <br /> beverages for onsite consumption to Olive Garden, located at 1305 S IH 35. <br /> Shannon Mattingly, Development Services Director, provided the Council with <br /> a brief overview of the appeal submitted by Robert Jett and the Conditional <br /> Use Permit approved by the Planning & Zoning Commission for Olive Garden. <br /> Mayor Guerrero opened the Public Hearing at 7:58 p.m. <br /> Keith Moore, Director of Development for Darden Restaurants, spoke in <br /> opposition of the appeal and doesn't feel that there will be a high use of Hays <br /> Street by its patrons. He stated that Olive Garden is willing to put signage up <br /> to deter the use of Hays Street as an exit point from the property. He asked <br /> that the Council maintain the P&Z vote and that they look forward to being a <br /> good corporate citizen. <br /> Ken Jenkins, 203 W. McCarty Lane, spoke in opposition of the appeal and that <br /> a majority of the people will want to take Interstate 35 out of the property and <br /> not a neighborhood street to exit the property. <br /> David Montelongo, 320 Patricia Drive, stated that his concern is when cars are <br /> trying to get out of the traffic when there is an accident on 35. He stated that <br /> people use the residential streets as a detour. When the traffic is on 35 and <br /> they go to these restaurants it will just create more traffic problems in the <br /> neighborhoods. <br /> Estella Enriquez, 514 Candlelight Lane, stated that she is also concerned with <br /> the traffic that is coming through their neighborhood.
