City Council Meeting Minutes January 19,2016 <br /> not being able to access their drive ways. <br /> Mrs (first name inaudible) Lopez,224 Barbara Drive, spoke about her <br /> concerns regarding the traffic in the neighborhood. She stated that she <br /> believes that patrons of the restaurant will try and go the easy way out even if <br /> there is a sign posted and this could cause accidents also. <br /> There being no further comments Mayor Guerrero closed the Public Hearing <br /> at 8:12 p.m. <br /> Main Motion: A motion was made by Deputy Mayor Pro Tern Prewitt, <br /> seconded by Council Member Hughson, that this appeal be denied with <br /> conditions. <br /> Council provided direction to Staff to place a future agenda item to discuss <br /> traffic issues throughout Sunset Acres and a Traffic Impact Study on Hays <br /> Street that is sufficient to legitimize "No Through Traffic" Signage. <br /> Motion to Amend: A motion was made by Council Member Gregson, <br /> seconded by Mayor Pro-Tem Thomaides, to amend to include the following <br /> conditions with the CUP: the placement of directional signage, no outdoor <br /> seating for dining, no amplified music other than the landscape speaker music <br /> that is not audible beyond the property line, trucks over 30 must ingress and <br /> egress from the IH35 service entrance. The motion carried by the following <br /> vote: <br /> For: 6- Mayor Guerrero, Mayor Pro-Tern Thomaides, Deputy Mayor Pro Tern Prewitt, <br /> Council Member Hughson, Council Member Derrick and Council Member <br /> Gregson <br /> Against: 1 - Council Member Prather <br /> Main Motion: the appeal of Conditional Use Permit (CUP-15-38) was denied <br /> with conditions as amended. Staff will, moving forward, have discussions with <br /> residents in and around new projects such as this one. <br /> For: 6- Mayor Guerrero, Mayor Pro-Tern Thomaides, Deputy Mayor Pro Tern Prewitt, <br /> Council Member Hughson, Council Member Derrick and Council Member <br /> Gregson <br /> Against: 1 - Council Member Prather <br /> NON-CONSENT AGENDA <br /> 11. Consider approval of Resolution 2016-09R, approving a Professional Services <br /> Agreement with Vickrey & Associates, Inc. for the provision of Engineering Services in <br /> connection with the CM Allen Parkway Reconstruction Project in a not to exceed <br /> amount of $80,790.00 which includes a prior increase of $19,706.99 (ACTS No. 1) and <br /> an increase of $31,540.00 (ACTS No. 2) above the previous not to exceed contract <br /> City of San Marcos Page 6 <br />
