<br /> 71 <br />Regular Meeting November 27, 1995 Page 3 <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING CHAPTER 21, PUBLIC SAFETY, OF THE SAN MARCOS <br /> CODE OF ORDINANCES TO CHANGE ASSIGNMENT PAY FOR POLICE <br /> DEPARTMENT FIELD TRAINING OFFICERS AND K-9 HANDLERS FROM A <br /> PER-SHIFT BASIS, AND TO PROVIDE ASSIGNMENT PAY FOR CRIMINAL <br /> INVESTIGATORS IN THE POLICE DEPARTMENT; INCLUDING PROCEDURAL <br /> PROVISIONS; AND PROVIDING FOR PENALTIES; AND DECLARING AN <br /> EFFECTIVE DATE. <br />Mr. Moore moved for approval of the Ordinance on second reading and <br />to amend the Ordinance to be adopted on emergency and Mr. Cox <br />seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1994-95 <br /> FISCAL YEAR TO PROVIDE FOR END-OF-YEAR RECONCILIATION OF <br /> REVENUES AND EXPENDITURES AND DECLARING AN EFFECTIVE DATE. <br />Mr. Moore moved for approval of the Ordinance on second reading and <br />to amend the Ordinance to be adopted on emergency and Mr. Guerra <br />seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration a motion to remove from <br />the table and adoption of a Resolution, the caption which was read <br />as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING THE SALE OF THE OLD FIRST CHRISTIAN CHURCH, <br /> LOTS 3 AND 4, BLOCK 15, ORIGINAL TOWN OF SAN MARCOS TO THE <br /> ABUNDANT LIFE CHRISTIAN CHURCH; AUTHORIZING THE CITY MANAGER TO <br /> EXECUTE A DEED; AND DECLARING AN EFFECTIVE DATE. <br />Mr. Moore moved to remove the Ordinance from the table and adopt the <br />Resolution with a waiver of the amount of bid security and Mr. <br />Guerra seconded the motion. Mr. Hart stated he was not aware the <br />earnest money submitted with the bid was an insufficient àmount <br />until during the Thanksgiving Holiday when he was reading his packet <br />and a newspaper article. Mr. Moore asked if a waiver of the bid <br />security was adequate and if it was considered a substantial change <br />from the bidding procedure. Mr. Taylor advised the City Council can <br />waive this requirement. Earle Moseley stated they were a young <br />congregation and presented the Council with a letter from Larry <br />Hammonds stating they were working with the bank to meet the <br />requirements of the bid. Mr. Cox stated other bidders may have been <br />dissuaded because of the 5% requirement. Mr. Hart stated the 5% <br />requirement is in place to make it difficult for bidders to renege <br />on a deal with the City. He is not willing to waive the additional <br />$9,000 the 5% requires (bidder submitted $1,000), but is willing to <br />give them a few days to submit the difference. Mayor Morris stated <br />the reason the City placed the property for bid was because the <br />citizens cannot afford to refurbish the building, and if Abundant <br />Life Christian Church purchases the property, it will become their <br />issue to deal with. Mr. Moore asked Mr. Hart if 15 days to submit <br />the $9,000 would address Mr. Hart's concern. Mayor Morris suggested <br />Friday, December 1. Mr. Moore moved to amend his motion by friendly <br />amendment to allow the bidder until Monday, December 4 at 5:00 p.m. <br />to deliver the additional $9,000 security to the City Secretary's <br />Office and Mr. Guerra seconded by friendly amendment. On roll call <br />for adoption of the Resolution, the following vote was recorded: <br /> AYE: Moore, Mooney, Hart, Morris, Guerra, Hernandez. <br /> NAY: Cox. <br />ABSTAIN: None. <br />
