4. Reconvene and Consider Action on Item Discussed During Executive Session. • <br />The San Marcos City Council reconvened into regular session at 6:51 p.m. on Tuesday, June 2, <br />2009. Council gave direction to staff regarding possible economic incentives. <br />5. Invocation <br />Pastor Sam Montoya, with Sinai Pentecostal Church, provided the invocation. <br />6. Pledge of Allegiance <br />Councilmember Thomaides led the assembly in the Pledge of Allegiance. <br />7. Citizen Comments <br />Carl Fryar, 940 Field Street, spoke regarding keeping other animals. He has a rooster and hen, <br />and they are like a domesticated animal for the family. This ordinance was passed and went into <br />law April 1. He received a citation and had to remove the animals. Notifications were posted on <br />the web and on bulletin boards. He feels this was not adequately noticed. He suggested that this <br />could come up for another vote for people like himself to have an opportunity to speak. <br />Jennifer Guerrero, 715 Barbara, voiced her opposition to a daytime curfew. She stated that it is • <br />not necessary when two house bills were passed in 2007 that provided that violators would be <br />taken back to their respective school. She is concerned that homeschooled kids will be picked up <br />when they are outside for exercise or for an assignment. Home educated students should be <br />exempted from daytime curfew rules. <br />Paul Geiger, 101 Six Pines, stated that 5,000 feet of his property is adjacent to the proposed <br />annexation. He reported that he was not notified of the annexation; and therefore, was not able <br />to file a protest. This will result in increased runoff, traffic, and increased sewage lines in the <br />aquifer. He also noted that the property is considered to be in the 500 year flood plain. He <br />reported that in the time he has lived there, he has seen flood waters over this area at least four <br />times. Only reason he can see to annex this property is to provide an entrance to Windemere <br />One, but the developer would require more width for a proper entrance. He voiced concern that <br />since he would not sell any of his property for this, the developer might try to convince the <br />Council to condemn his property and give to him for an entrance. He stated that annexation in a <br />flood-prone area is of no gain. <br />Robert Lopez, 655 Landa, reported that he had submitted his grant application for minor home <br />repairs for low income seniors and others. The grant was submitted for $50,000 to do home <br />repairs for 25 homes for anyone within the CDBG guidelines. <br />Steve Harvey, 1116 Mountain View, reported on his ancestral roots in this area and expressed his <br />appreciation for what the San Marcos River means to the community. There are two agenda <br />items, items 18 and 21 that provide the possibility to impact the river negatively.
