• MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to adopt Zoning Ordinance <br />2009-29, as previously captioned. The motion carried unanimously. <br />18. Public Hearing to receive comments for and against Ordinance 2009-30, annexing to <br />the City an area consisting of 22.5 acres, more or less, T.J. Chambers Survey A-2, located 1 <br />mile northwest of Post Road at Lime Kiln Road; approving a service plan for this area; <br />including procedural provisions; and declaring an emergency. <br />At approximately 8:07 p.m. Mayor Narvaiz opened the Public Hearing. <br />Tyler Carlson, 136 Hunters Glen, stated this is a special area, and we need to take notice of this. <br />He has seen much of the tract under water in the past 15 years. Adding rooftops and streets will <br />increase runoff and pollution to the creek. It is environmentally sensitive and is the last few <br />hundred yards before surface water and underground recharge feed Spring Lake and the San <br />Marcos River and is home to five endangered species. This Sink Creek corridor is the only <br />corridor of mostly raw land left feeding quality water to the river headwaters and recharging the <br />aquifer. He is concerned that once development is approved, then other development will <br />demand to come in. Texans who use Edward's water have been told to conserve, but what <br />message does it send if we support intense development along this recharge feature. It is <br />inconsistent to demand taxpayers pay to protect the springs and drink surface water while also <br />forcing them to pay for wastewater lines and roads that endanger the springs. <br />• Michelle Bussemey, 2608 Green Leaf, President of the San Marcos River Foundation <br />encouraged Council to vote against this ordinance. This is not a place we want development. It <br />is the last remaining area feeding into our river, and the Nature Conservancy has designated the <br />area as one of the places they want to see conserved. She would like to see development along I- <br />35 and move away from the recharge zone, the river and the lake. She asked Council to please <br />listen to the constituents and save our river, our springs and our lake. <br />Daniel Sage, 2300 Hilliard, said he doesn't remember being asked if he was willing to give away <br />70 acres, and this impacts our lives. This is a ridiculous use for this acreage. It is a very <br />valuable spot. The only puma in Hays County raised her young in the cave. He volunteer to <br />reseed along Lime Kiln, but he feels this should be tabled for 30 days and have the people speak. <br />Lloyd O'Leary, 1700 Lime Kiln Road, lives with the headache of traffic every day. The City <br />does not have enough inspectors, and that is why foul up with the wrong pipe laid. PEC was at <br />his house last year, and they had an engineer do a study. His place alone has 300,000 cubic feet <br />of water heading down to the creek. In 1988 people could not get across Lime Kiln and Hilliard. <br />We do not need to develop this area. We don't need extra traffic or runoff with concrete and <br />everything else. <br />Tom Hays, Sciences director with the Greater Edwards Aquifer Alliance, said he is against the <br />annexation. This is a very important area, and he has been working on it actively in terms of <br />protection. It is of great importance to Sink Creek. He reiterated the Horizons Master Plan when <br />the citizens asked for very low density development in this area. There are sheet flows into Sink <br />RM060209 Minutes Page 5
