16. Consider Change Order #1 with Stokes Construction Company for a Rainwater <br />Collection Svstem for the San Marcos Fire Station No. 1 in an amount not to exceed <br />$75,233.00, and authorize the Citv Manager to execute Change Order #1. <br />Item 12 was pulled from the Consent Agenda. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Terry, the City Council voted seven (7) for and none (0) opposed, to approve the Consent <br />Agenda, less item 12. The motion carried unanimously. <br />(12)MOTION: Upon a motion made by Councilmember Couch and a second by <br />Councilmember Porterfield, the City Council voted seven (7) for and none (0) opposed, to adopt <br />Ordinance 2009-28, as previously captioned. The motion carried unanimously. <br />(14)MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to reconsider item 14. The <br />motion carried unanimously. <br />(14)MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to adopt Resolution 2009- <br />76R, as previously captioned. Center , <br />$ 53 <br />860 <br />• #13 City Development Services Program Administration , <br />$100 <br />000 <br />• 44 City Community Services-Parks Eddie Durham Park , <br />$105.070 <br />END OF CONSENT AGENDA <br />17. Public Hearing to receive comments for and against an amendment to the future land <br />use map from Mixed Use (MU) to Public and Institutional (P) for a 5.000 acres, more or <br />less, tract of land located in the 3300 Block of Trail Ride Pass; amending the official <br />zoning map of the City by rezoning this tract from Mixed Use District to Public and <br />Institutional District; and including procedural _provisions, and consider adoption of <br />Zoning Ordinance 2009-29. <br />At approximately 8:03 p.m. Mayor Narvaiz opened the Public Hearing. <br />Ben Heimsmith, 2108 EM Franklin, thanked Planning and Zoning, staff and Council for their <br />positive response. <br />There being no further comments, the Public Hearing was closed at 8:04 p.m. <br />RM060209 Minutes Page 4
