5 <br />Regular Meeting October 9, 1995 Page 4 <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as <br />follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY-BY REZONING <br />A 0.9 ACRE TRACT OF PROPERTY LOCATED AT 2517 I.H.35 SOUTH FROM <br />"C" (COMMERCIAL DISTRICT) TO "LI" (LIGHT INDUSTRIAL DISTRICT) <br />AND DECLARING AN EFFECTIVE DATE. <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak for or against the zoning amendment. No one did, so Mayor <br />Morris closed the public hearing. Mr. Guerra moved for adoption of <br />the Zoning Ordinance and Mr. Moore seconded the motion, which passed <br />unanimously. , <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as <br />follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 0.78 ACRE TRACT OF PROPERTY LOCATED AT 2050 I.H. 35 SOUTH, <br />FROM "I" (INDUSTRIAL DISTRICT) TO "C" (COMMERCIAL DISTRICT) AND <br />DECLARING AN EFFECTIVE DATE. <br />Mayor Morris opened the public hearing and asked if anyone wished to <br />speak for or against the zoning amendment. No one did, so Mayor <br />Morris closed the public hearing. Mr. Hart stated he had filed a <br />conflict of interest form with the City Secretary and would abstain <br />from voting on this matter. Mr. Moore moved for adoption of the <br />Zoning Ordinance and Mr. Cox seconded the motion. On roll call the <br />following vote was recorded: <br />AYE: Moore, Mooney, Morris, Guerra, Cox, Hernandez. <br />NAY: None. <br />ABSTAIN: Hart. <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on third and final reading, the caption which was read as'follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, UPDATING AND CLARIFYING CERTAIN SECTIONS OF CHAPTER 37, <br />SEXUALLY ORIENTED BUSINESSES OF THE SAN MARCOS CODE OF <br />ORDINANCES; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />Mr. Moore moved for adoption of the Ordinance on third and final <br />reading and for amendment of the definition of bar on Page 2 of the <br />Ordinance by adding a clause to read, 11(6) Bar means a business <br />which offers its customers alcoholic beverages for on-premise <br />consumption, and derives 51a or more of its income from the sale of <br />alcoholic beverages for on-premise consumption," and Mr. Hart <br />seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration approval of minutes of the <br />Regular Meeting held September 25, 1995 and Special Meeting held <br />October 2, 1995, approval of two Ordinances on second reading, <br />adoption of an Ordinance on third and final reading, adoption of six <br />Resolutions, approval to ratify the use of General Fund Contingency <br />Funds for the appraisal, environmental study and purchase of a 3.25 <br />acre tract of land located along Chestnut Street, approval to bid <br />for sale a portion of Lot 4, Block 8 of the McKie 2nd Addition (112 <br />Love), and approval to set the Regular Meeting dates for the City <br />Council Meetings in December to be Monday, December 4, 1995 at 7:30 <br />p.m. and Monday, December 11, 1995 at 7:30 p.m. (instead of December <br />11, 1995 and December 25, 1995) on consensus. The Council removed <br />Items 9.A.(1), minutes of Regular Meeting held September 25, 1995, <br />and 9.D.(3), adoption of a Resolution, to be considered separately.
