8 <br />Regular Meeting <br />October 9, 1995 <br />Page 7 <br />Mayor Morris introduced an Executive Session pursuant to the <br />Government Code, Section 551.071, to discuss pending litigation <br />(Sierra Club vs. Babbit; Medina County U.W.C.D. vs. Barshop, <br />E.U.W.D. vs. Allen), contemplated litigation, and matters where the <br />City Attorney's ethical duty to the City clearly conflicts with <br />Government Code Chapter 551; Sections 551.072 and 551.073, to <br />discuss the value of real property; and Section 551.074, to discuss <br />the duties of a public officer (Mayor). Mr. Moore moved the Council <br />adjourn into Executive Session at 9:02 p.m. and Mr. Mooney seconded <br />the motion, which passed unanimously. <br />Mr. Moore moved the Council reconvene at 10:16 p.m. and Mr. Guerra <br />seconded the motion, which passed unanimously. <br />Mayor Morris introduced a discussion regarding the Texas Natural <br />Resource Conservation Commission (TNRCC) Wastewater Permit Amendment <br />Administrative Proceeding and whether to oppose the proposal for <br />decision issued October 2, 1995. It was consensus of Council not to <br />oppose the proposal. <br />The meeting adjourned at 10:20 p.m. on motion made by Mr. Guerra and <br />seconded by Mr. Hart. <br />V'?&Al 1A/Aj <br />?
