Mr. Moore stated the project is a good <br />concept, but the drainage and traffic impacts have to be addressed. <br />He thinks this would be a good buffer if the streets, drainage and <br />topography were all right. Mr. Cox stated Mr. Lindstrom wants to <br />have an age restriction in the development and Mr. Taylor stated it <br />can legally be done. Mr. Cox stated he had talked with Mr. Chaney <br />and he had indicated he was not opposed to the development but <br />opposed to development he doesn't know much about. William Peterson <br />stated a developer can change and not do what he says he will do. <br />Debbie Austin stated age discrimination would not be enforceable. <br />On roll call the following vote was recorded: <br /> AYE: Moore, MooneYt Morris, Guerra, Cox, Hernandez. <br /> NAY: Hart. <br />ABSTAIN: None. <br />Mayor Morris stated there is a need for this concept. The Council <br />instructed Staff to work with everyone and try to reach a solution <br />without a crucial impact. <br /> . <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF Sfu~ ~ffiRCOS, <br /> TEXAS, COMBINING THE COMMISSION FOR MINORITIES, COMMISSION FOR <br /> WOMEN, SENIOR CITIZENS ADVISORY BOARD AND FAIR HOUSING <br /> COMMISSION INTO A NEW HUMAN DEVELOPMENT COMMISSION¡ INCLUDING <br /> PROCEDURAL PROVISIONS¡ AND DECLARING AN EFFECTIVE DATE. <br />Mr. Moore moved for approval of the Ordinance on first reading and <br />Mr. Mooney seconded the motion. Mr.-Moore moved to amend the <br />Ordinance to delete disability under the minority definition and add <br />ethnic minority in Section 2-125(1). Mr. Taylor advised the <br />representation of the board is determined in Section 2-126(b), and <br />Mr. Moore withdrew his motion. The Council directed Staff proceed <br />with the establishment of a Senior Citizens Facility Board for the <br />activities of the Georgia Street Center. The Council voted <br />unanimously for approval of the Ordinance on first reading. <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, <br /> TEXAS, AMENDING ARTICLE II, DEFINITIONS, AND ARTICLE VI, <br /> SUBDIVISION DESIGN REQUIREMENTS, OF APPENDIX C - SUBDIVISIONS <br /> OF THE SAN MARCOS CODE OF ORDINANCES TO REVISE THE DEFINITION <br /> OF "FLAG SHAPED LOT" AND TO PROVIDE EXCEPTIONS TO THE <br /> PROHIBITION OF SUCH LOTS WITHIN SUBDIVISIONS¡ INCLUDING <br /> PROCEDURAL PROVISIONS¡ AND PROVIDING PENALTIES FOR VIOLATIONS. <br />Mr. Guerra moved for approval of the Ordinance on first reading and <br />Mr. Cox seconded the motion, which passed unanimously. <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on third and final reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, AMENDING ORDINANCE 1994-42 TO REVISE SEWER SuKCHARGE <br /> RATES¡ INCLUDING PROCEDURAL PROVISIONS¡ PROVIDING FOR PENALTIES <br /> AND DECLARING AN EFFECTIVE DATE. <br />Mr. Moore asked if this Ordinance fails, would the wastewater rates <br />have to be raised, and Mr. Gilley stated yes. Mr. Moore moved for <br />adoption of the Ordinance on third and final reading, to amend the <br />Ordinance to revise the surcharge participant list threshold, and to <br />revise the surcharge formula, as described in Mr. Taylor's <br />memorandum dated September 20, 1995, and Mr. Cox seconded the <br />motion, which passed unanimously. <br />
