Mr. Cox stated the property owner needs direction what he <br />can do with his property. Mr. Hart stated the property needs to <br />follow the Master Plant and have the area conform. Mr. Cox asked if <br />Mr. VanKleef would be interested in pursuing DP-2 zoningt and Mr. <br />VanKleef stated he would prefer DP-2 to R-l zoning. Mr. 'VanKleef . <br />indicated their project would be an improvement to a declining <br />neighborhood. On roll call the following vote was recorded: <br /> <br />AYE: None. <br /> <br />NAY: Moore, MooneYt Hart, Morris, Guerra, Cox, Hernandez. <br />ABSTAIN: None. <br /> <br />The Council directed the Planning and Development Staff to initiate <br />DP-2 zoning on this property and to bring the residents opposed to <br />the development into the dialogue. <br /> <br />Mayor Morris introduced for consideration a public hearing and <br />adoption of a Zoning Ordinance, the caption which was read as <br />follows: <br />. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING <br />A 3.38 ACRE TRACT OF PROPERTY LOCATED AT THE CORNER OF PROSPECT <br />AND QUARRY STREETS FROM IR-1" (SINGLE-FAMILY RESIDENTIAL <br />DISTRICT [LOW DENSITY]) TO "TH-I" (TOWNHOUSE RESIDENTIAL <br />DISTRICT [LOW DENSITY]) AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Morris stated the owner of the property, Jack Lindstrom, is <br />ill and unable to be at this meeting. Mayor Morris opened the <br />public hearing and asked if anyone wished to speak. Jack Chaney,. <br />Chair of the Heritage Neighborhood Association, noted the Council <br />has received petitions opposing this rezoning. The neighborhood is <br />opposed to the zoning because they are concerned with drainage, want <br />to maintain the present low density of the neighborhood, the area <br />will not handle more traffic, want to preserve the uniqueness of the <br />neighborhood continuity of style and maintain the appearance of the <br />neighborhood. Debbie Austin, a resident of Quarry Street, provided <br />photographs of drainage problems in the area, stated the <br />infrastructure would not tolerate more use and the water pressure is <br />already low. She stated this project could consist of 16 units, <br />which would impact the integrity of the neighborhood. Carl Deal <br />stated we all know Jack Lindstrom as being a good citizen. He <br />stated impact and integrity to the neighborhood are what lS in <br />question. He stated this project has the potential to cause an <br />impact to the neighborhood. Bill Peterson, who resides at the <br />corner of Scott and Burleson, stated an additional problem is the <br />possibility of how many might be living in this development. He <br />stated more people and cars than TH-l zoning permits could inhabit <br />this development and he agrees with Planning and Zoning's denial. <br />Nina pryatel stated she likes the concept Mr. Lindstrom has in mind <br />and is for this rezoning. She thinks it is a good idea and could <br />be restricted in size. Jim Brace, representing Buddy Mostyn, stated <br />they are opposed to this rezoning. George VonderLippe of 1229 <br />Belvin stated he is opposed to this change and wants the property to <br />remain as is. He thinks townhouses for senior citizens would be a <br />good idea but not at this location. He does not want more than 3 <br />units per acre to be allowed and would want more restrictions on the <br />townhouses. Joel Barnard resides on Bishop Street and thinks the TH <br />zoning would be appropriate. He stated drainage would need to be <br />resolved before building permits are issued, and the density is the <br />same density as R-1. He stated the uniqueness of the neighborhood <br />he certainly would want maintained, and that Mr. Lindstrom would be <br />interested in living in something along these lines. He stated <br />zoning needs to be enforced if there is a problem, he is impressed <br />with Mr. Lindstrom's project and thinks there may need to be more <br />dialogue. Rodney Vanoudekerke of 323 Scott and Larry Hammonds of <br />309 Quarry both stated they are opposed to this zoning change. No <br />one else wished to speak, so Mayor Morris closed the public hearing. <br />
