<br />95 <br /> <br /> <br />Regular Meeting September 11, 1995 Page 2 <br /> <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, SETTING THE TAX RATE FOR THE 1995 TAX YEAR¡ LEVYING <br />TAXES FOR THE USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF <br />THE CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1995, AND -- <br />ENDING SEPTEMBER 30, 1996, PROVIDING A SINKING FUND FOR THE <br />RETIREMENT OF THE BONDED DEBT OF THE CITY, AND DECLARING AN <br />EMERGENCY. <br /> <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Cox seconded the motion, which passed unanimously. <br /> <br />Mayor Morris introduced for consideration adoption of an Ordinance <br />on emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, ADOPTING A BUDGET FOR THE FISCAL YEAR BEGINNING ON <br />OCTOBER 1, 1995 AND ENDING ON SEPTEMBER 30, 1996¡ REPEALING ALL <br />ORDINANCES IN CONFLICT WITH THIS ORDINANCE¡ AUTHORIZING <br />TRANSFERS OF FUNDS WITHIN DEPARTMENTS WITH THE APPROVAL OF THE <br />CITY MANAGER¡ APPROVING FISCAL YEAR 1995-1996 CAPITAL <br />IMPROVEMENTS PROGRAM PROJECTS AND DECLARING AN EMERGENCY. <br /> <br />Mr. Moore moved for adoption of the Ordinance on emergency and Mr. <br />Cox seconded the motion. Mayor Morris moved to amend RECITAL 3. to <br />add the date of August 1, 1995, and RECITAL 4. to add the date of <br />August 14, 1995 and Mr. Moore seconded the motion, which passed <br />unanimously. Mayor Morris moved to amend the Ordinance to provide <br />$20,000.00 funding from the Hotel/Motel Fund Balance to the <br />Confederate Air Force for repairs to the rails and doors. Jim Lux <br />of the CAF advised the Council they received two bids for these <br />repairs. Mr. Lux also stated the recent Air Show was successful, <br />and surveys show they penetrated the San Antonio market. He stated <br />they appreciate all the support of the City and community. The <br />Council voted unanimously for approval to fund $20,000.00 from the <br />Hotel/Motel Fund Balance for these repairs. The Council discussed <br />the request from SummerFest for funding for next summer's <br />activities. The Council directed we wait a couple months to see <br />what CVB funding they receive to support their activities before the <br />Council decides whether or not additional funding is even heeded. . <br />The Council then voted unanimously for adoption of the Ordinance. <br />Mr. Guerra stated one of the social service agencies the City will <br />provide funding to this year is Victory Outreach, which is an agency <br />with a religious nature. He stated he is opposed to funding such an <br />agency, because it could cause problems in the future. Mr. Gilley <br />stated fund balances are in place to prepare the City for unforeseen <br />occurrences. He stated with the electric utilities being above <br />ground, the expenses involved are larger, and therefore need to have <br />a larger fund balance. <br /> <br />Mayor Morris introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />fu~ ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, UPDATING AND CLARIFYING CERTAIN SECTIONS OF CHAPTER 32, <br />SEXUALLY ORIENTED BUSINESSES OF THE SAN MARCOS CODE OF <br />ORDINANCES¡ INCLUDING PROCEDURAL PROVISIONS¡ AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mr. Guerra moved for approval of the Ordinance on first reading and <br />Mr. Moore seconded the motion. A map with the areas indicating <br />where businesses can be located was reviewed with Council. The area <br />has expanded by the outlet mall ana Wonder World area. Mr. Guerra <br />asked if the changes will withstand legal challenge, and Mr. Taylor <br />advised they willi and there is a conviction on appeal now for the <br />Talk of the Town. The Council voted unanimously for approval of the <br />Ordinance on first reading. <br />
