<br />21 <br /> <br />Regular Meeting <br /> <br />July 24, 1995 <br /> <br />Page 5 <br /> <br />Aye: Mooney, Guerra, Cox, Moore <br /> <br />Nay: Hernandez <br /> <br />Mayor Pro-Tem Mooney introduced for consideration a public hearing and adoption <br />of a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY BY REZONING A 0.48 ACRE TRACT OF PROPERTY LOCATED AT <br />THE INTERSECTION OF VALLEY STREET AND FREDERICKSBURG <br />STREET FROM "M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD <br />BUSINESS DISTRICT AND "C" COMMERCIAL DISTRICT TO "L1" LIGHT <br />INDUSTRIAL DISTRICT AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Pro-Tem Mooney opened the public hearing and asked if anyone wished to speak. <br />No one did so Mayor Pro-Tem Mooney closed the public hearing. Mr. Guerra moved for <br />approval of the Zoning Ordinance and Mr. Cox seconded the motion which passed <br />unanimously. <br /> <br />Mayor Pro-Tem Mooney introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR <br />THE 1994-1995 FISCAL YEAR TO PROVIDE FUNDING FOR RIVER ROAD <br />AREA IMPROVEMENTS PROJECT; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Cox moved for adoption of the Ordinance on emergency and Mr. Hernandez seconded <br />the motion. The following vote was recorded: <br /> <br />Aye: Mooney, Guerra, Cox, Hernandez (Mr. Moore not present) <br /> <br />Mr. Taylor stated that because of the fact there were only four votes for approval of the <br />Ordinance to place the funding for that project there is a subsequent item on the agenda <br />that needs to be pulled and that the project cannot be awarded because the funds are not <br />in place unless the Council wishes to reconsider. Mr. Moore stated he had just come in <br />the door and his vote was Aye. The Ordinance passed unanimously. <br /> <br />Mayor Pro-Tem Mooney introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY <br />OF SAN MARCOS, TEXAS, GENERAL OBLIGATION REFUNDING <br />BONDS; SERIES 1995; IN THE AGGREGATE PRINCIPAL AMOUNT OF <br />$11.200.000; LEVYING AN ANNUAL AD VALOREM TAX TO PAY SAID <br />BONDS; PRESCRIBING THE FORM OF SAID BONDS; AWARDING THE <br />SALE THEREOF; APPROVING THE OFFICIAL STATEMENT; ENACTING <br />OTHER PROVISIONS RELATING TO THE SUBJECT AND DECLARING AN <br />EMERGENCY. <br />
