21 Regular Meeting July 24, 1995 Page 5 Aye: Mooney, Guerra, Cox, Moore Nay: Hernandez Mayor Pro-Tem Mooney introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.48 ACRE TRACT OF PROPERTY LOCATED AT THE INTERSECTION OF VALLEY STREET AND FREDERICKSBURG STREET FROM "M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT AND "C" COMMERCIAL DISTRICT TO "L1" LIGHT INDUSTRIAL DISTRICT AND DECLARING AN EFFECTIVE DATE. Mayor Pro-Tem Mooney opened the public hearing and asked if anyone wished to speak. No one did so Mayor Pro-Tem Mooney closed the public hearing. Mr. Guerra moved for approval of the Zoning Ordinance and Mr. Cox seconded the motion which passed unanimously. Mayor Pro-Tem Mooney introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY BUDGET ORDINANCE FOR THE 1994-1995 FISCAL YEAR TO PROVIDE FUNDING FOR RIVER ROAD AREA IMPROVEMENTS PROJECT; AND DECLARING AN EMERGENCY. Mr. Cox moved for adoption of the Ordinance on emergency and Mr. Hernandez seconded the motion. The following vote was recorded: Aye: Mooney, Guerra, Cox, Hernandez (Mr. Moore not present) Mr. Taylor stated that because of the fact there were only four votes for approval of the Ordinance to place the funding for that project there is a subsequent item on the agenda that needs to be pulled and that the project cannot be awarded because the funds are not in place unless the Council wishes to reconsider. Mr. Moore stated he had just come in the door and his vote was Aye. The Ordinance passed unanimously. Mayor Pro-Tem Mooney introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS, TEXAS, GENERAL OBLIGATION REFUNDING BONDS; SERIES 1995; IN THE AGGREGATE PRINCIPAL AMOUNT OF $11.200.000; LEVYING AN ANNUAL AD VALOREM TAX TO PAY SAID BONDS; PRESCRIBING THE FORM OF SAID BONDS; AWARDING THE SALE THEREOF; APPROVING THE OFFICIAL STATEMENT; ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT AND DECLARING AN EMERGENCY.
