<br />28 <br /> <br /> <br /> <br />Regular Meeting May 22, 1995 Page 5 <br /> <br /> <br />Mr. Moore moved for adoption of the Resolution and to amend Section <br />9 to read, "Any member of the Planning and Zoning Commission. . . <br />to follow the procedure established in section ~ of this Article," <br />and Mr. Hart seconded the motion. The Council requested there be <br />more notice of the public hearing regarding the subdivision review. <br />The Council voted unanimously for adoption of the Resolution. <br /> <br />I Mayor Morris introduced for consideration Item 9.C. (9) removed from <br />, the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN INTERLOCAL <br />AGREEMENT FOR ROADWAY IMPROVEMENTS BETWEEN THE CITY, THE SAN <br />MARCOS.CONSOLIDATED INDEPENDENT SCHOOL DISTRICT, AND HAYS <br />COUNTY; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT <br />ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for adoption of the Resolution and Mr. Cox seconded <br />the motion. Mayor Morris inquired about reimbursement of costs of <br />the design work, and Mr. Taylor stated the cost sharing provisions <br />are on Page 8 of the agreement. Mr. Hart stated he wants à further <br />discussion of the costs at the next Joint Workshop. On roll call <br />the following vote was recorded: <br /> <br />AYE: Moore, Hart, Morris, Guerra, Cox, Hernandez. <br /> <br />NAY: Mooney. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Morris introduced for consideration Item 9.B. (15) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LICENSE <br />AGREEMENT BETWEEN THE CITY AND THE LOWER COLORADO RIVER <br />AUTHORITY FOR RELOCATION OF TRANSMISSION LINES FOR THE RIVER <br />ROAD PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Moore moved for adoption of the Resolution and to amend to <br />attach the license agreement and Mr. Hart seconded the motion, which <br />passed unanimously. <br /> <br />Mayor Morris introduced the City Manager's Report. (1) City Staff <br />and SWT representatives have been working together on an habitat <br />conservation plan for the San Marcos River. We have wanted to do <br />selective desiltation at various points of the river, which requires <br />us to obtain a permit from the U. S. Army Corps of Engineers, which <br />also triggers a consultation process by the U. S. Fish and Wildlife <br />Department. U. S. Fish and Wildlife concerns stem around the <br />endangered species, and they are therefore reluctant to grant <br />¡ approval of this without an habitat conservation plan. It was <br />! consensus in the City/SWT meeting to develop an habitat conservation <br />! plan in close consultation with U. S. Fish and Wildlife. One <br />I recommendation made at the city/SWT meeting was to have an employee <br />directly employed by U. S. Fish and wildlife and the city and SWT <br />contribute to that cost. Mr. Gilley stated it was his opinion the <br />person should be employed by either the city or SWT. The estimated <br />cost for this employee would be $35,000-$40,000, and could be shared <br />equally by the city and SWT. Mayor Morris expressed concern with <br />the silt buildup and the city being blamed for all matters of the <br />river through the Wastewater Treatment Plant, and how this will <br />affect all problems that occur along the river. Mr. Gilley stated <br />it will in some way address all those problems whether or not it <br />specifically identifies the point and nonpoint source pollutants. <br />The plan would not only address the immediate problem but would also <br />deal with prevention of that recurring. This would mean looking at <br />the Drainage, Erosion Control and River Corridor Ordinances, etc., <br />
