(7) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING A DEED CORRECTING THE DEED CONVEYING A TRACT <br />OF PROPERTY IN BLOCK 12 OF D. S. COMBS ADDITION TO TUTTLE <br />LUMBER COMPANY; AUTHORIZING REIMBURSEMENT OF $1,776.59 TO <br />TUTTLE LUMBER COMPANY; AUTHORIZING THE CITY MANAGER TO EXECUTE <br />THE CORRECTION DEED; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Hart moved for adoption of the Resolution and Mr. Moore seconded <br />the motion. Mr. Mooney asked if the surveyor should be held <br />responsible for this charge. Mr. Taylor advised the surveyor did <br />not charge to correct the error, and we are selling less property <br />for a proportionate amount. We never owned the property, so this <br />would not actually be a loss to the city. The Council voted <br />unanimously for adoption of the Resolution. <br /> <br />Mayor Morris introduced for consideration Item 8.B. (8) removed from <br />the consensus agenda, adoption of a Resolution, the caption which <br />was read as follows (Mr. Guerra present at this time - 7:41 p.m.): <br />. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT <br />BETWEEN THE CITY AND CAPITAL AREA RURAL TRANSPORTATION SYSTEM <br />(CARTS) FOR THE ESTABLISHMENT AND OPERATION OF A PUBLIC TRANSIT <br />SYSTEM IN THE CITY; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Moore moved for adoption of the Resolution and Mr. Hart seconded <br />the motion. Mayor Morris moved to amend the Agreement in Section 2. <br />Term, to add the following sentence' at the end of this Section, <br />"CARTS' performance under this agreement will be contingent upon its <br />continued receipt of state and federal funding to operate the <br />System," and in Section 5. Routes and Schedules. to amend the last <br />sentence in the Section to read, "During the period from April 1, <br />1995 . . . the schedule will provide for two-hour intervals between <br />vehicles passing the same stop rather than one-hour intervals," and <br />Mr. Guerra seconded the motion, which passed unanimously~ Mr. <br />Mooney asked why we are paying 50% of the annual charge and not <br />getting all the service, and Ms. Huffman replied CARTS will run the <br />service and must pay the start-up costs. They need the additional <br />funds to get started. Mayor Morris moved to amend Section 2. Term, <br />for the term of the Agreement to end September 30, 1996, and Mr. <br />Hart seconded the motion, which passed unanimously.~. Gilley <br />responded to Mr. Hart Staff is comfortable in overseeing the shelter <br />issue and administration of this program. There will initially be <br />seven shelters. In response to Mr. Hart's question if Staff can <br />measure to evaluate the performance of CARTS, Mr. Gilley stated <br />Staff can do this, and most importantly will be 10.b.3., the <br />percentage of the public transit demands identified in CARTS' <br />January 23, 1995 report to the City Council of the City that are <br />being served by the System. Mr. Gilley also advised the Council <br />CARTS will be in charge of advertising. On roll call for adoption <br />of the Resolution the following vote was recorded: <br /> <br />~ AYE: Moore, Hart, Morris, Guerra, cox, Hernandez. <br /> <br />NAY: Mooney. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Morris introduced a presentation by the Noon Lions Club <br />regarding the 1995 plans for tube rentals, extension of float down <br />San Marcos River to Thompson's Island (Stokes Park), River Taxi <br />Franchise and additional advertising on IH35. Mr. Gilley advised <br />the Council the Lions Club has requested an amendment to extend the <br />length of tube rides from Rio Vista to Thompson's Island. They want <br />to raise the fee, have requested curb cuts and for Cape Road to be <br />
